[HISTORY: Adopted by the Mayor and Council of the Borough of Red Bank by Ord. No. 2003-34; amended in its entirety by Ord. No. 2004-22 (Sec. 3-13 of the 1987 Revised General Ordinances). Subsequent amendments noted where applicable.]
As used in this chapter, the following terms shall have the meanings indicated:
NURSING HOME
Any licensed health care facility, hospital, institution, care center, convalescent home, old-age home, nursing home, and any other establishment or institution for the care, treatment, lodging or nursing of persons mentally ill, mentally deficient or mentally retarded, acutely or chronically ill, or who are crippled, convalescent, infirm or in any way afflicted, or who reside therein for any purpose whatsoever.
All nursing homes within the Borough of Red Bank shall be and are hereby required to have immediately available a private ambulance service or a private van-type vehicle suitable to be used as an ambulance for the conveyance of nonambulatory as well as emergency patients as the need arises. All nursing homes shall also have a backup or secondary service for such transportation need.
All nursing homes shall file proof of the availability of such emergency ambulance or equivalent-type carrier service with the office of the Borough Clerk on or before July 1, 2004. Such detailed proof will include the details of the ambulance or van-type vehicle available to the nursing home as required by this chapter, including the names, addresses, telephone numbers and contact person as to both the primary and backup or secondary service for such transportation needs. Further, the nursing home shall update this filing with the Borough Clerk at any time when there is a change with regard to service and on or before January 1 of each and every year thereafter.
All nursing homes within the Borough of Red Bank shall prominently post at the emergency desk of each nursing home and such other places as may be appropriate in the particular nursing home (so that calls may be promptly and accurately made to the appropriate service) the name, telephone numbers as well as the methodology for employees or other persons manning the facility to contact the transportation service.
Any person or entity violating any of the provisions of this chapter, including the provision of filing the details and proof of the availability of such emergency vehicles to the nursing home and the requirement to post the information to insure that nursing home personnel are cognizant of the procedure to contact the transportation service shall be liable to pay a fine of $500 per day for each offense.
In the event the nursing home does not substantially follow the methodology set forth in this chapter with regard to a primary and secondary contact for transportation arrangements but rather knowingly contacts the Red Bank First Aid for such transportation, First Aid may file a complaint in the Municipal Court against such person or entity and the penalty in such event will be a fine of $500 for the first violation and a minimum fine of $1,250 for each and every violation thereafter.
