The local law set forth within this chapter shall be known and may be cited as the "Junk Storage Control Law of the Town of Union Vale."
The Town Board hereby declares that a clean, wholesome and attractive environment is of vital importance to the continued general welfare of the Town's citizens, and that regulation of the deposit, accumulation or maintenance of junk regardless of quantity is hereby prohibited anywhere within the Town of Union Vale. By adoption of this chapter the Town declares its intent to preserve and promote a reasonable quality of environment and aesthetics and to prohibit actions and conduct that tend to depreciate not only the property on which the actions or conduct occur but also the property of other persons in the neighborhood and the community generally.
The provision of this chapter shall apply in addition to the provisions of any other local law or ordinance adopted by the Town, including but not limited to Chapter 154, Junkyards, and Chapter 161, Littering, of the Town Code. Where there may be conflict between any of the provisions of this chapter and any other local law or ordinance adopted by the Town, the more restrictive provision shall apply.
For purposes of this chapter, each of the below terms shall have the meaning set forth herein:
BONA FIDE WORK OF ART
An original object of an established art form possessing positive aesthetic qualities and created by the artist upon application of his or her skills and with the intent of both expressing human emotion or exhibiting an individual point of view and producing a work of art, the term "bona fide work of art" not to be construed to include any object produced for prior, present or future utilitarian purpose.
GARBAGE
All putrescible animal and vegetable wastes resulting from the growing, processing, marketing and preparation, cooking and consumption of food items, including any container in which such food item may be packaged.
JUNK
Worn out or discarded material objects or personal property of little or no value and no longer fit for the use intended, including but not limited to abandoned, worn out, damaged, destroyed or discarded machinery or appliances, furniture, mobile homes, boats, snowmobiles, all-terrain vehicles, marine and/or aircraft items, motor vehicles or trailers or such other device, vehicle or machinery which is in a state of disrepair or is otherwise dilapidated, broken or abandoned, which in the case of motor vehicles shall be deemed to be the state of any vehicle not presently in condition for legal use on the public highways, or any accumulation of parts thereof; or garbage, rubbish and debris.
OUTDOOR STORAGE
The placing, maintaining or keeping of garbage, junk, rubbish and debris in a place other than a structure with a roof and fully enclosed on all sides.
RUBBISH AND DEBRIS
Ordinary household or commercial trash such as paper and paper products, barrels, cartons, boxes, cardboard, cans, glass, metals, plastics, rubber, crates, rugs, clothing, rags, discarded bedding, tires, lumber, brick, stone, steel and other building materials no longer intended or in condition for ordinary use in constructing a permitted building or making any other authorized improvement on the premises; and any and all tangible personal property no longer intended or in condition for ordinary or customary use.
