It shall be unlawful for any owner, custodian or keeper of a
dog or dogs to allow or permit a dog to commit a nuisance on any public
property or on any private property which is detrimental to the public
health and welfare by reason of repeated barking, howling or yelping
of any dog in such manner as to disturb or annoy persons in the neighborhood.
Continuous barking, howling or making of other loud noises by
such dog for more than one hour or continuous barking for periods
of less than one hour but more than 1/2 hour, which periods occur
on two or more consecutive days, shall be deemed a nuisance.
Any owner, custodian or keeper of any dog shall, as soon as
practicable, upon notice by or on behalf of the owner of any property,
whether public or private, other than the property of the dog's
owner, of any action by the dog, remove in any sanitary method all
feces deposited by the dog on such property, and the same shall be
deposited in the owner's garbage or disposed of in some other
sanitary method. The deposits shall be properly wrapped, packaged
or protected so as to prevent unsightly disposal, smell or interference
with the health and welfare of the community.
The Borough of Boyertown has entered into an agreement with
the Humane Society of Berks County so that the society will perform
certain services for stray and domestic dogs. As a part of the agreement,
the society will charge the Borough a fee, plus mileage, to pick up
stray or abused dogs. If the owner of the dog(s) can be identified,
the total cost of the pickup shall be billed to that owner.

Any owner, custodian or keeper of any dog who shall violate any of the provisions of this chapter shall, upon conviction before a District Justice, pay a fine of not less than $25 nor more than $300. No penalty under this section shall be imposed upon any owner, custodian or keeper for a violation of § 64-1 or 64-2 of this chapter, unless written warning of such action has first been served upon such person or mailed to him 30 days prior to instituting proceedings for the collection of such penalty, and unless a written complaint of such violation has been made to the Borough of Boyertown by at least one adult resident citizen.
