As used in this chapter, the following terms shall have the meanings indicated:
OTHER WEEDS
Includes, among other things, burdock, garlic or wild onion, goldenrod, horse nettle, milkweed, mullen, poison ivy, quack grass, ragweed, sumac, wild carrot, wild lettuce, wild mustard, wild parsnip and all other types of weeds and grasses (other than in bona fide agricultural plantings) which have attained a height in excess of eight inches.

It shall be the duty of every person, firm or corporation owning, leasing, holding, possessing, controlling or managing land or lands within the corporate limits of the Borough of Boyertown, Pennsylvania, upon which land or lands any Canada thistles, or weeds commonly known as "Canada thistles," or Cichorium intybus, the weed commonly known as "chickory" or "succory" or "blue daisy," or any other weeds grow, to cut or destroy the same whenever such weeds have attained a height in excess of eight inches, so as to prevent such seed from ripening.
It shall be the duty of every person, firm or corporation owning, leasing, holding, possessing, controlling or managing any land or lands within the Borough of Boyertown to maintain trees, shrubbery and ornamental plantings by proper trimming and thinning to prevent said shrubs and ornamental plantings from being so dense as to obstruct sidewalks or roadways or to be deemed by the Board of Health to be a possible haven and breeding area for rodents and therefore detrimental to the public's health. Any trees overhanging the sidewalk shall be trimmed so that the sidewalk is unobstructed for a height of at least seven feet above the sidewalk. Any trees overhanging the roadway shall be trimmed so that the street is unobstructed for a height of no less than 13 feet six inches above the roadway.

If any person or persons or any corporation holding any land or lands as aforesaid shall neglect or refuse to cut or destroy weeds as required by §§ 70-2 and 70-3 of this chapter, it shall be lawful for the Borough authorities to enter upon the premises of such person or persons or corporations and cut down and destroy said weeds as well as to trim and thin overly dense trees, shrubs or ornamental plantings, and the cost of cutting or destroying such weeds or trimming such overly dense trees, shrubs or ornamental plantings shall be charged to such person, persons or corporations and shall be collected as debts owed to the Borough are collected.

Any person or persons or corporation violating any provisions of this chapter shall, in addition to being liable for any costs incurred by the Borough authorities under this chapter, also be subject to a fine of not less than $10 and not more than $600, together with costs of prosecution. Separate citations can be issued each and every day in which violations exist.
