This article is enacted to regulate the sale and transportation
of alcoholic beverages in the Township in accordance with the provisions
of an act of the Legislature of the State of New Jersey entitled "An
Act Concerning Alcoholic Beverages," comprising Chapter 436 of the
Laws of 1993, its supplements and amendments, and also comprising
N.J.S.A. 33:1-1 et seq., and in accordance with the rules and regulations
of the State Director of Alcoholic Beverage Control.
For the purpose of this article, words and phrases used in this
article shall have the same meanings as in N.J.S.A 33:1-1 et seq.
and the rules and regulations of the Director of the Division of Alcoholic
Beverage Control.
All applications for licenses and all licenses issued and all proceedings under this article shall be in accordance with the act, rules and regulations referred to § 89-1, and all other applicable laws of the State of New Jersey or the United States.
All licenses required by this article shall be issued by the
Township Committee, which shall also administer the provisions of
this article.
No person shall sell or distribute alcoholic beverages within the Township without having obtained a license in accordance with the act referred to in § 89-1 and the provisions of this article.

A.
The annual license fees and maximum number of licenses for the sale
or distribution or the consumption of alcoholic beverages in the Township
of Ocean shall be as follows:

B.
The fee which shall be paid for a person-to-person transfer application
shall be 10% of the annual license fee. The fee that must be paid
to the municipality for a place-to-place transfer application shall
be 10% of the annual license fee. In the event there is a combined
person-to-person and place-to-place transfer application submitted,
the applicant shall pay a fee equal to 20% of the annual license fee.
These fees are retained by the Township, whether or not the transfer
is granted. In addition, a fee of $200, payable to the Division of
Alcoholic Beverage Control, must accompany the form forwarded from
the municipality to the Division for a new license, renewal of a license
or transfer of a license. This fee shall be retained by the state,
whether or not the transaction is approved.
C.
The provisions of this section with respect to the limitation as
to the number of licenses shall not apply to the renewal or transfer
of licenses presently issued.
D.
Pursuant to N.J.S.A. 33:1-12(2), no seasonal consumption license
shall be granted within the Township.
