No alcoholic beverages shall be sold, delivered or served to consumer or consumed in any licensed premises except as to retail distribution which is further modified herein, on any day between the hours of 2:00 a.m. and 7:00 a.m., except Sundays and New Year's Day each year as hereinafter modified.
The provisions of § 89-7 shall not apply on Sundays. On Sundays, no alcoholic beverages may be sold, served, delivered to or consumed in the licensed premises, except as to retail distribution of alcoholic beverages as defined and limited hereinbelow, between the hours of 3:00 a.m. and 7:00 a.m.
Provisions of § 89-7 shall not apply on January 1. On that day, no alcoholic beverages may be sold, served, delivered to or consumed in the licensed premises, with the exception of retail distribution of alcoholic beverages as defined and limited hereinbelow, between the hours of 5:00 a.m. and 7:00 a.m.
No alcoholic beverages, including malt alcoholic beverages and wine, may be sold for retail distribution except between the hours of 9:00 a.m. and 10:00 p.m. each and every day of the week.
No licensee or employee of licensee shall sell, serve or deliver, directly or indirectly, any alcoholic beverages to any habitual drunkard, intoxicated person or minor, nor permit the consumption of alcoholic beverages on any licensed premises by any of the above-named classes of persons, or permit any such persons to congregate in or about the licensed premises.

A "minor" is an individual under the age of 21 years.
A. 
Presence. No minor shall be allowed in any premises where alcoholic beverages are sold or served for consumption on the premises unless accompanied by his parent or guardian.
B. 
Purchase of alcoholic beverages by a minor. No minor shall purchase, attempt to purchase, or have another purchase for him/her any alcoholic beverage on any premises licensed for the sale of alcoholic beverages.
C. 
Purchase of alcoholic beverages for a minor. No person shall purchase or attempt to purchase alcoholic beverages for a minor. It is unlawful for any person to induce or attempt to induce any licensee or any employee of licensee to sell, serve or deliver alcoholic beverages to minor.
D. 
Misstating age. No person shall misrepresent his/her age or the age of another person for the purpose of inducing any licensee or his/her employee to sell, serve or deliver any alcoholic beverage to person under 21 years or to permit person under 21 years to remain on any premises in violation of Subsection A of this section.
E. 
Presumption. Any parent or guardian of minor who accompanies such minor into premises in which alcoholic beverages are served and who permits the minor to possess or consume alcoholic beverages shall be presumed to have misrepresented the age of the minor.
F. 
Possession. No minor shall possess, serve, sell or consume any alcoholic beverage in any public place within the Township.
A. 
Any license issued under this article may be suspended or revoked for violation of any of the provisions of this article or any provision of any applicable statute or any of the rules and regulations of the State Director of Alcoholic Beverage Control.
B. 
Proceedings for suspension or revocation shall be in accordance with the provisions of N.J.S.A 33:1-31 by service of five-day notice of charges preferred against the licensee and affording a reasonable opportunity for hearing.
C. 
Suspension or revocation of license shall be in addition to any other penalty which may be imposed for violation of this article.

Each alcohol establishment licensee is required to insure all front of the house employees (managers, servers, hosts, bartenders, and bus employees) are certified and keep current a certification in alcohol management. TIPS (Training for Intervention Procedures) and TAMS (Techniques of Alcohol Management) certifications will be accepted. Additional programs may be acceptable and will be determined on an individual basis. The alcohol establishment licensee will keep, on record, a copy of employee certification numbers and expiration dates as part of employee files and, upon request, shall attach all TIPS or TAMS program current cards to their E141A forms for inspection.

A. 
Any person violating or failing to comply with any of the provisions of this article shall, upon conviction thereof, be punishable by a fine of not to exceed $2,000, by imprisonment for a term not to exceed 90 days or by community service of not more than 90 days, or any combination of fine, imprisonment and community service as determined in the discretion of the Municipal Court Judge. The continuation of such violation for each successive day shall constitute a separate offense, and the person or persons allowing or permitting the continuation of the violation may be punished as provided above for each separate offense.
B. 
The violation of any provision of this article shall be subject to abatement summarily by a restraining order or injunction issued by a court of competent jurisdiction.
