Unless a different meaning clearly appears from the context, the following words shall have the following meanings:
APPLICATION
A formal submission of documents and supporting plans and other materials submitted to the Department in accordance with its most recent rules and regulations.
COMMERCIAL DEVELOPMENT
Any building or structure engaged in service, trade, business, traffic or commerce in general, exclusive of industrial development.
DEPARTMENT
The Ocean Township Water and Sewer Utility Department.
DEVELOPER
The person, persons, company or corporation performing site improvements.
DRY SANITARY SEWER
A sewer which is constructed to carry sewage or wastewater, but not intended to be placed in service until downstream sanitary sewer facilities are completed as some later date.
INDUSTRIAL DEVELOPMENT
Any building or structure engaged in manufacturing or processing operations.
OWNER
The property upon whose behalf the site improvements are to be made.
PLANNING BOARD
The Planning Board of the Township of Ocean. However, this term shall also include the Zoning Board of Adjustment if applicable.
PREAPPLICATION DETERMINATION
A formal submission of documents and supporting plans and other materials submitted to the Department for a decision on whether a connection to the sanitary sewer shall be required, dry lines installed or a waiver recommended.
SANITARY SEWER
A sewer which carries sewage or wastewater.
SEWER MASTER PLAN
The existing sanitary sewers and future sanitary sewer extensions, to sewer the Township of Ocean, as determined by the Department or as the Department shall determine.
SEWER SYSTEM
All interceptors, trunks, sanitary sewers, service connections and pumping stations owned by the Department in public streets or easements.
TOWNSHIP
The Township of Ocean.
Developers of all residential subdivisions and all commercial and industrial development shall submit to the Department for a preapplication determination. The Department shall determine if the developer shall be required to connect to the sanitary sewer, which may include extending the sewer system or the installation of dry sanitary sewers and on-site septic systems, or the Department may recommend a waiver for such connections or dry sanitary sewer at this time. If the Department determines that a connection to the sewer system shall be required or dry sanitary sewers installed, the developer shall file with the Department such preliminary and final applications in accordance with the Departments' rules and regulations and construct the required sanitary sewer facilities. If the Department recommends that the connection to the sewer system or installation of dry sanitary sewers may be waived, the Township Committee shall adopt a resolution showing the reasons for recommending the waiver and shall forward a certified copy of the resolution to the developer and the Planning Board.
All Planning Board approvals shall be conditioned on approvals by the Water and Sewer Utility Department. The Planning Board shall not be bound by a recommendation of the Department to waive requiring the developer to connect to the sewer system or to install dry sanitary sewers. The Planning Board may accept or reject said recommendation based upon the facts presented to it.
Continuation of the site improvements may resume at such time when the Planning Board adopts a resolution waiving the connection requirements or upon approval by the Department of a final application and the owner or developer securing all county and state permits necessary in order to make connection to the sanitary sewer system or construction of dry sanitary sewers.

No certificate of occupancy shall be issued to the owner until the owners who are determined to connect to the sanitary sewer or construct dry sanitary sewers complete said sanitary sewer facilities in accordance with the Department's rules and regulations and until the Department fully accepts the sanitary sewer facilities in accordance with procedures defined in said rules and regulations.

No building permit shall be issued by the Township until such time as the developer has received all necessary approvals or waivers from the Township's Utility Department and Planning Board. In addition, no building permit shall be issued unless and until the developer has paid all utility connection fees for sewer and/or water for the entire project in full.
A. 
Any person violating or failing to comply with any of the provisions of this chapter shall upon conviction thereof, be punishable by a fine of not more than $1,000, by imprisonment for a term not to exceed 90 days or by community service of not more than 90 days, or any combination of fine, imprisonment and community service as determined in the discretion of the municipal court judge. The continuation of such violation for each successive day shall constitute a separate offense, and the person or persons allowing or permitting the continuation of the violation may be punished as provided above for each separate offense.
B. 
The violation of any provision of this chapter shall be subject to abatement summarily by a restraining order or injunction issued by a court of competent jurisdiction.
In addition to the penalties hereinabove provided, if the owner of property in the Township of Ocean shall fail or refuse to make any connections or installation required by the chapter within the time or times herein provided, the Ocean Township Water and Sewer Utility Department may proceed to make such connection or installation or cause the same to be made and assess the cost or charges against such property in accordance with the delinquency provisions of the rules and regulations of the Ocean Township Water and Sewer Utility Department.
