The following regulations are made and established for the proper
use, operation and maintenance of the park facilities in the Township
or county.
A.
These regulations shall apply to the park facilities in the Township
which shall be open during the hours posted by the Township Committee.
B.
The Township Committee shall determine the season or period of each
year when each of the park facilities shall be opened and closed.
C.
No person shall do any of the following things at, upon, or in the
immediate vicinity of the park:
(1)
Dress or undress in a motor vehicle or use it as a place for sleeping;
(2)
Discard any paper, bottle, container, food, drink, garbage or other
refuse upon any beach or in the water adjacent thereto;
(3)
Litter, damage, destroy, or disfigure any part of the beach or park
facilities or any public or private property thereon;
(4)
Fish at or from any bathing beach. Hunting in park area is prohibited;
(5)
Take or consume any alcoholic beverage in the park or at the beach
or in the water adjacent thereto;
(6)
Take or permit a dog or horse on any bathing beach or in the water
adjacent thereto in the park area;
(7)
Go into or remain in the water of any bathing beach when directed
by a police officer or another authorized person to leave the water
or when in an intoxicated condition;
(8)
Molest or disturb any person in the peaceful enjoyment of any of
the beach or bathing facilities or do anything which might endanger
the life or safety of himself or herself or any other person;
(9)
Go beyond the water limits designated or authorized for bathing and
swimming purposes;
(10)
Refuse or neglect to obey the orders and directions of any police
officer or other authorized person as to the time, place or areas
for bathing;
(11)
Use or permit the use of water skis or boats in any bathing
area except for lifesaving or emergency purposes;
(12)
Eat, drink, or picnic in any area except those designated for
these purposes;
(13)
Peddle, vend, purvey, sell, distribute, or otherwise dispose
of any food, drink, goods, wares and merchandise on any bathing beach.
D.
Chaperones
for groups; lifeguards.
(1)
Adequate supervision must be provided. Department policy requires
one chaperone for every 10 bathers. The chaperone must be dressed
appropriately to be able to attempt a water rescue, if needed. When
more than three children are in the water, it is advisable that the
chaperone be in the water with them;
(2)
Each group shall provide their own lifeguard or the Township will
provide one and charge the groups the 2002 rate of $50 per day;
(3)
Chaperones should be able to swim so that the lifeguards will not
have to rescue two victims. Chaperones that attend must be able to
swim;
(4)
Groups will adhere to the lake operation hours;
(5)
Groups must police their area prior to leaving. All trash must be
placed in the receptacles;
(6)
The recreation department must be notified if the group's scheduled
days change. Failure to notify the recreation department could result
in the loss of lake privileges as well as monetarily compensating
the Township for the guards that were scheduled.
E.
However, the Township Committee may, in its discretion, and only
by written resolution, authorize the sale and/or consumption of alcoholic
beverages sold at the Waretown Lake are by any duly organized, nonprofit
corporation, whose essential function is to provide emergency services
to the residents of the Township such as the Waretown First Aid Squad,
Inc. and/or the Waretown Volunteer Fire Company, or for any events
sponsored by the Township under the following terms and conditions:
(1)
The applicant must have written approval from the New Jersey Alcoholic
Beverage Control Commission, a Division of the New Jersey Department
of Law and Public Safety for the dispensing of such alcohol.
(2)
The only alcohol permitted to be consumed at the Waretown Lake area
shall be that sold and/or distributed by the entity conducting the
event which has been approved by the Township Committee.
(3)
For any event not sponsored and/or being conducted by the Township,
the entity conducting such an event and/or sales shall be required
to provide an insurance certificate naming the Township as an additional
insured for said event in the minimum amount of $1,000,000.
(4)
The Chief of Police of his or her designee shall be authorized to
terminate the sale, distribution and/or consumption of any alcoholic
beverages at any time, if, in his or her designee's opinion, the public
health or safety is at risk.
(5)
The permittee shall be required to comply with any and all conditions
imposed by resolution of the Township Committee which authorizes such
sale or consumption.
(6)
Prior to the submission of a request for the use of the lake area
for such a purpose, the applicant shall be required to provide any
additional information which may be required by the Ocean Township
Police Department regarding the sale, distribution, or consumption
of such alcoholic beverages at the lake area.
(7)
Applicant shall be required to indemnify the Township, its agents,
servants and/or employees from any and all claims brought by any person
or entity as a result of any injury or damage incurred by any person
or entity as a result of the sale and/or consumption of alcoholic
beverages in accordance with this section.
(8)
This section shall not require the Township Committee to grant any
such approval and each and every application and/or request shall
be considered separately and be decided upon accordingly by the Township
Committee.[1]

The Township Committee may from time to time adopt rules and
regulations pertaining to the issuance of licenses and the supervision
and control of the park facilities.
Any person convicted of a violation of any provision of this
article shall pay a fine of not more than $100 or be imprisoned in
the Ocean County Jail for a term of not more than 30 days or both,
at the discretion of the court.
No parking zones are created within the Waretown Memorial Park
on all beach, picnic and tennis court areas.
