It is the policy of the Township to maintain a work place free of sexual harassment from any source. Sexual harassment, whether committed by a supervisor, employee, the public or any elected official, shall be strictly prohibited.
A. 
Unwelcomed sexual advances, requests for sexual favors and other verbal or physical conduct of a sexual nature or intended to be taken in that context shall constitute "sexual harassment" when:
(1) 
Submission to such conduct is made either explicitly or implicitly a term or condition of an individual's employment;
(2) 
Submission to or rejection of such conduct by an individual is used as the basis for employment decisions affecting such individual; or
(3) 
Such conduct has the purpose or effect of substantially interfering with work performance or creates an intimidating, hostile or offensive work atmosphere.
B. 
"Sexual harassment" does not refer to behavior or occasional compliments of a socially acceptable nature. It refers to sex-based behavior that is not welcome; is personally offensive; fails to respect the rights of others; lowers morale; or interferes with work performance.
C. 
"Sexual harassment" may take different forms, including but not limited to;
(1) 
Verbal. A demand for sexual favors, sexual innuendos, suggestive comments, jokes of a sexual nature, sexual propositions or threats.
(2) 
Nonverbal. Dissemination of sexually suggestive objects or pictures, graphic commentaries, suggestive or insulting sounds, obscene gestures, leering or whistling.
(3) 
Physical. Unwanted physical contact, touching, pinching, brushing the body, assault or sexual activity.
All forms of sexual harassment are prohibited.
A. 
If an employee believes he or she has been subject to sexual harassment, the employee should immediately notify his or her supervisor or the Personnel Committee.
B. 
The Personnel Committee shall promptly investigate the complaint. Such investigation will remain, to the maximum extent feasible, confidential, on a strict need-to-know basis. Should the investigation reveal that harassment has occurred, the Mayor and Council shall take immediate steps to ensure that such conduct does not reoccur.
A. 
The Mayor and Council shall see that the appropriate disciplinary action is taken against any party found to have violated this article. Discipline shall follow the procedures described in this chapter and may take any of the forms set forth in § 46-85.
B. 
Any employee found to have engaged in sexual harassment shall be subject to discipline as provided by the Code of the Township of Allamuchy, including termination from employment. Any elected official found to have engaged in sexual harassment shall be publicly censured. Any member of the public found to have engaged in sexual harassment of a Township employee or elected official of the Township shall be prosecuted to the fullest extent permitted by law.
