A. 
Any person who keeps or proposes to establish a kennel, pet shop, shelter or pound shall apply to the Warren County Health Department for a license entitling that person to keep or operate such establishment. Such application shall describe the premises where the establishment is located or is proposed to be located and the purpose or purposes for which it is to be maintained and shall be accompanied by the written approval of the Sanitary Inspector of the Township of Allamuchy showing compliance with municipal and state rules and regulations. These facilities may be located within the Township only where permitted by the Township Zoning Ordinance.[2]

B. 
The annual fee for any license required to be issued pursuant to this section, including a license for a boarding or breeding kennel, shall be as stated in N.J.S.A. 4:19-15.9.
C. 
The application for a license issued pursuant to this section shall state the name and address of the owner of the facility and the number of animals that shall be accommodated at the facility and shall be accompanied by the written approval of the Health Officer and Certified Animal Control Officer showing compliance with the municipal and state rules and regulations governing the location and sanitation of such establishment. The license application may further require proof of liability and property insurance in adequate amounts as determined by the Township Council and/or any individual acting as an agent of the Township of Allamuchy. Prior to issuance of a license, the Allamuchy Township Land Use Board must approve a site plan of the subject facility, and the applicant must obtain a certificate of occupancy before commencing operations. Any license issued pursuant to this article shall be nontransferable.
D. 
All licenses issued for a kennel, pet shop, shelter or pound shall state the purpose for which the establishment is maintained, and all such licenses shall expire on the last day of January of each year and may be subject to revocation by the municipality on recommendation of the New Jersey State Health Department, Township Council and/or any individual acting as an agent of the Township of Allamuchy or the Certified Animal Control Officer of the Township of Allamuchy for failure to comply with the rules and regulations of the state or the municipality, after the licensee has been afforded a hearing by either the New Jersey State Health Department or the Warren County Health Department.
E. 
Any person who violates any provision of this section shall, upon conviction thereof, be liable to the general penalty in Chapter 1, Article II, General Penalty, of the Township Code. For purposes of this subsection, each week during which a person operates such facility without a license shall constitute a separate offense.

A. 
The welfare of animals is of prime concern to the governing body of the Township of Allamuchy. Therefore, all kennels, pet shops, shelters and pounds shall comply with the regulations set forth at N.J.A.C. 8:23A-1.1 et seq.
B. 
In addition to the standards set forth at N.J.A.C. 8:23A-1.1 et seq., the following standards shall apply:
(1) 
All dog kennels shall be located on a minimum of three acres of land.
(2) 
The owner or operator of a kennel shall reside on the premises in a single detached home.
(3) 
Any kennel, pet shop, shelter or pound which sells any animal to a laboratory, hospital or any other person or facility for purposes of experimentation upon said animal shall, upon conviction thereof, be liable to the general penalty in Chapter 1, Article II, General Penalty, of the Township Code and loss of license.
C. 
Unless provided otherwise herein, any person who shall violate this section or N.J.A.C. 8:23A-1.1 et seq., shall be liable to the general penalty in Chapter 1, Article II, General Penalty, of the Township Code.
