All business uses, whether permitted directly or as conditional
uses in the following zones — the VN Village Neighborhood
District, CC Community Commercial District and PO Professional Office
District, are deemed subject to the provisions of this chapter and
all retail businesses operating as nonconforming uses in any district,
except for hotels and motels; uses requiring the obtaining of an alcoholic
beverage license in order to conduct such activity; business offices
associated with such retail activity, provided that proper security
may be maintained in connection with the operation of such business
office; and bus passenger stations.
No operator of a retail business in the Township of Allamuchy
shall deliver or allow or sell goods or services of any nature whatsoever
from such premises on weekdays between the hours of 12:00 midnight
and 5:00 a.m. or on Saturdays between the hours of 12:00 midnight
and 5:00 a.m. or on Sundays between the hours of 12:00 midnight and
5:00 a.m. During the hours that the sales of goods and/or services
are prohibited, all retail business premises shall be closed.
The provisions of this chapter and the full compliance therewith shall be enforced by the Zoning Officer of the Township of Allamuchy and may be further enforced by the lawful authority of the State Police of the State of New Jersey, who serve as the municipal police force for the Township of Allamuchy. Any retail business remaining open during prohibited hours shall be subject to the penalty provisions of the Code of the Township of Allamuchy set forth in § 1-15 of the Code of the Township of Allamuchy. Any violation shall constitute a separate violation of this provision, and each day such violation shall occur shall consist of a separate violation pursuant to the penalty provisions of the Code of the Township of Allamuchy.
