The purpose of this chapter is to establish
a policy regarding fees to be charged for special services in providing
access of public records to the public pursuant to N.J.S.A. 47:lA-2.
As used in this chapter, the following terms
shall have the meaning indicated:
The effort involved in retrieving and reproducing document(s)
requested.
The staff person responsible for preparing the document requested.
The time needed to comply with the request over and above
the first quarter hour.
As defined pursuant to N.J.S.A. 47:lA-1 et seq.
Determined by the nature, format, manner of collation or
volume of the record to be inspected, examined, copied or reproduced
and the reproducibility of the record in the format requested.
A.Â
A special service charge may be applied by the Custodian
of Records or his/her designee in the following circumstances:
(1)Â
When the nature, format, manner of collation or volume
of a government record embodied in the form of printed matter to be
inspected, examined or copied is such that the record cannot be reproduced
by ordinary copying equipment in ordinary business size or involves
an extraordinary expenditure of time and effort to accommodate the
request; or
(2)Â
When a request is for a government record in a medium
not routinely used by the Borough; or
(3)Â
When a request is for a government record not routinely
developed or maintained by the Borough; or
(4)Â
When a request for a government record requires a
substantial amount of manipulation or programming of information technology
by the Borough and the cost of such manipulation or programming is
not otherwise included in the fee or fees listed in the Borough's
policy.
B.Â
The costs for providing document(s) other than in
format available in Borough offices shall be based on the cost charged
to the Borough for reproducing document in requested format and the
time spent by Borough staff to comply with request.
C.Â
The special service charge shall be determined as
follows:
(1)Â
The hourly rate shall be the hourly wage of the employee
fulfilling the request.
(2)Â
The hourly wages of salaried personnel shall be calculated
by dividing the employee's annual salary by the total number of hours
worked by the employee annually.
(3)Â
The charge shall be based on one-quarter-hour increments
after the first one-quarter hour spent in complying with the request.
