The owner or owners of record of any property ("record owner"), as reflected by the tax duplicate prepared by the Board of Assessment of Montgomery County, as updated from time to time, or of each individual residential dwelling unit that receives the benefit of trash collection by the Township pursuant to Article I of this chapter shall pay an annual fee to the Township for the collection, removal and disposal of garbage, refuse, and trash (the "residential refuse fee").
The amount of the residential refuse fee shall be set at a rate established by the Board of Commissioners by resolution, which residential refuse fee shall be charged annually until such time as it is amended or rescinded by resolution.
The residential refuse fee shall be billed to the record owner and shall be collected by the Treasurer of the Township. The Treasurer shall be compensated for said collection at a rate to be established by resolution by the Board of Commissioners.
The residential refuse fee for each dwelling unit shall be due and payable not more than four months following the date on which the Township and County real estate tax bill is dated (the "tax billing date"). The record owner shall be entitled to a two-percent discount for the payment of the residential refuse fee within two months of the tax billing date. Any residential refuse fee not paid within four months of the tax billing date shall have added thereto a penalty of 10%. Any residential refuse fee not paid within five months of the tax billing date, in addition to the said penalty, shall accrue interest thereafter at the annual rate of 10% until it shall be paid.
In addition to collection by any means provided by law, including, but not limited to, civil actions before a magisterial district judge or in the Court of Common Pleas, any residential refuse fee not paid within seven months of the tax billing date shall be subject to collection by the filing of a municipal lien in accordance with the Municipal Claims Law, as amended, 53 P.S. § 7101 et seq.
In addition to the other remedies provided herein, the Township may discontinue the collection of trash and refuse from any property for which there is a delinquent residential refuse fee.
