Former Ch. 104, Fire Prevention, adopted 2-8-1971 by Ord. No. 475, approved 2-8-1971, was superseded 3-22-2004 by Ord. No. 711. See now Ch. 86A, Construction Codes, Uniform.
A certain document, a copy of which is on file in the office of the Fire Chief of the Borough of Wilson, known as the International Fire Code, 2006 Edition, including all appendix chapters and later amendments and special interpretations to the 2006 Edition, as published by the International Code Council, be and is hereby adopted as the Fire Code of the Borough of Wilson, Northampton County, Pennsylvania, regulating and governing the safeguarding of life and property from fire and explosion hazards arising from the storage, handling and use of hazardous substances, materials and devices and from conditions hazardous to life or property in the occupancy of buildings and premises as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Fire Code on file in the office of the Borough of Wilson are hereby referred to, adopted, and made a part hereof, as if fully set out in this chapter, with the additions, insertions, deletions and changes, in any, prescribed in § 104-2 of this chapter.
The following sections are hereby revised:
A. 
Section 101.1, insert: "Borough of Wilson" as the name of the jurisdiction.
B. 
Section 109.3, insert, in part, under Violation penalties, that it is a "summary offense punishable by fine of not less than $100 or more than $300, and costs of prosecution, and, in default of payment of such fine and costs, to imprisonment not exceeding 90 days, or both such fine and imprisonment."
C. 
Section 111.4, insert under Failure to comply concerning any person who shall continue any work after being served with a stop-work order, "shall be liable to a fine of not less than $100 or more than $300."
The geographic limits referred to in certain sections of the 2006 International Fire Code are hereby established as follows: With respect to Sections 3204.3.1.1., 3404.2.9.5.1, 3406.2.4.4 and 3804.2, the geographic limits shall be those limits established by law applicable in the Borough of Wilson pertaining to the various zoning districts within the Borough.
This article specifically repeals Section 3.3(d) and any other provisions of Borough Ordinance No. 471 relating to the BOCA Basic Fire Prevention Code and all ordinances or parts of ordinances in conflict herewith.
Nothing in this article or in the Fire Code hereby adopted shall be construed to affect any suit or proceeding, impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance or part thereof hereby repealed as indicated in § 104-4 of this article, nor shall any just or legal right or remedy of any character be lost, impaired or affected by this article.
