§ 145-2
Obstructions prohibited. 

A. 

The obstruction of public roadways, drainageways or bridges is unlawful and, for the purpose of this article, is construed to include, but is not limited to, the following:

(1) 

Any person or persons who erect or construct any obstruction of any kind whatsoever, whether the same be by placing anything above the surface or by digging a ditch, entrance or exit for a walk or driveway, with or without pipe or other drain incident thereto, or other excavation of any kind in, on or under any road, sidewalk, footwalk, culvert, drain, bridge or the slope, berm or abutment adjacent thereto, so as to interfere temporarily or permanently with the convenient or practical use of said road, sidewalk, footwalk, culvert, drain, bridge, or the slope, berm or abutment adjacent thereto within the Township of Daugherty.

(2) 

Any person or persons who desire to erect or construct any temporary obstruction as above set forth shall first obtain from the Secretary of the Board of Supervisors of Daugherty Township a permit therefor, for which, he, she or they shall pay a fee set by the Board of Supervisors and, in addition thereto, deposit with the Secretary of the Board of Supervisors a sum of money set by the Board of Supervisors to guarantee said obstruction will be removed and the road, sidewalk, footwalk, culvert, drain, bridge, or the slope, berm or abutment adjacent thereto or anything else disturbed or interfered with by said obstruction or construction shall be restored to its original condition or to the satisfaction of the Board of Supervisors. Thereupon, said sum of a fee set by the Board of Supervisors shall be returned to the depositor thereof; otherwise, this sum shall be retained by the Township to recover expenses incurred to restore the area of the temporary obstruction to its original condition.

(3) 

The Daugherty Township Police Department or Pennsylvania State Police shall be responsible for the enforcement of the provisions of this article.

B. 

Violations and penalties. Any person, firm, corporation or utility convicted of a summary offense in violation of this article of this chapter shall pay a minimum fine of $100 plus all filing and court costs.
