Former Art. VI, Unsafe Buildings, has been retained in this chapter.
All buildings or structures which are structurally unsafe, unsanitary
or are not provided with adequate egress, or which constitute a fire
hazard or are otherwise dangerous to human life, or which in relation
to existing use are a hazard to safety or health, by reason of inadequate
maintenance, dilapidation, obsolescence or abandonment, are severally,
for the purpose of this chapter, unsafe buildings. All such unsafe
buildings are hereby declared illegal and shall be abated by repair
and rehabilitation or by demolition in accordance with the procedure
of this chapter.
The Building Inspector shall examine or cause to be examined
every building reported as unsafe and shall make a written report
thereof.

Whenever
the Building Inspector shall find any building or structure or portions
thereof to be an unsafe building, as defined in this chapter, he or
she shall cause a notice to be served on the owner or some one of
the owner's executors, legal representatives, agents, lessees, or
any other person having a vested or contingent interest in same, either
personally or by registered mail addressed to the last known address,
if any, of the owner or some one of the owner's executors, legal representatives,
agents, lessees or other persons having a vested or contingent interest
in same, as shown by the records of the Receiver of Taxes and/or in
the office of the County Clerk.

Such notice
shall contain a description of the premises, a statement of the particulars
in which the building or structure is unsafe or dangerous and an order
requiring the same to be made safe and secure or removed. Said notice
shall specify the time within which the person served with such notice
shall commence the securing or removal of said building or structure,
and a reasonable amount of time shall be specified in such notice.
Such notice shall also state the time and place for a hearing before
the Town Board for the person served and such other persons having
an interest in the property or structure described therein.

The notice
shall contain a deadline for the removal of the building subsequent
to the hearing and shall state that, in the event such owner fails
or refuses to repair or remove such building or structure by the stated
deadline, the Town may remove said building or structure and that
the cost and expense of such removal will be assessed against the
land on which such building or structure is located.
