As used in this chapter, the following terms shall have the meanings indicated:
ALL-TERRAIN VEHICLE (ATV)
Any motorized off-highway vehicle designed to travel primarily off-highway 50 inches or less in width, having a manufacturer's dry weight of 1,500 pounds or less, traveling on three or more nonhighway tires, designed for operator use only with no passengers, having a seat or saddle designed to be straddled by the operator, and handlebars for steering control, except equipment such as lawnmowers. For purposes of this chapter, the term "all-terrain vehicle" shall mean a Class 1 ATV.
OFF-HIGHWAY MOTORCYCLE
Any two-wheeled motor vehicle, commonly referred to as a "motorcycle," which is designed for use off-highway.

It is the policy of this County to promote the public health, safety, comfort, morals, convenience and general welfare and to avoid noise, noxious or offensive activity carried on, in or near residences in Stephenson County.
All-terrain vehicles and off-highway motorcycles operated in Stephenson County shall be operated in conformity with state and federal law and more particularly with 625 ILCS 5/11-1427.

It shall be unlawful to operate an all-terrain vehicle or an off-highway motorcycle within Stephenson County within an area zoned E-1, E-2, E-3, R-1, R-2, R-3, R-4, or R-5, as defined and designated by Chapter 400, Zoning, or within 1,000 feet of a district so zoned by Chapter 400, Zoning, unless such vehicle is equipped with an exhaust system muffler device that will not amplify or increase the noise of said vehicle above that originally emitted by the muffler system installed in the vehicle by the manufacturer. Such replacement or original muffler shall be in good working condition and shall silence the report of the vehicle to an extent not less than the noise emissions of a new 1988 ATV or off-highway motorcycle. No ATV or off-highway motorcycle shall have an exhaust system with a cut-out or bypass or similar device.
Any person, firm or corporation who or which violates any provision of this chapter shall, upon conviction, be subject to penalties as set forth in Chapter 1, General Provisions, Article II, Penalties, § 1-11.
