The unnecessary emission of thick or dense black smoke, soot, dust, ash, cinders, noxious gases or other pollutions within the corporate limits of the Village of Nyack, from the smokestack of any steamboat, locomotive, steam roller, steam derrick, steam pile driver, tar kettle or other similar machine or contrivance, or from any smokestack or chimney of any building or premises used in connection with any stationary engine, steam boiler or furnace of any description, or from any other source within the corporate limits of the Village of Nyack, excepting for 20 minutes in any one hour during which time such fire is being cleaned or turned, or a new fire is being built therein, is hereby declared to be a public nuisance and is prohibited.
Any person who, or firm or corporation which, or his or their agents, servants or employees, operating or in charge or control of any steamboat, locomotive, steam roller, steam derrick, steam pile driver, tar kettle or other similar machine or contrivance, or any building or premises, shall cause or permit the unnecessary emission of thick or dense black smoke, soot, dust, ash, cinders, noxious gases or other pollutions within the Village, from the smokestack or chimney of such steamboat, locomotive, steam roller, steam derrick, tar kettle or other similar machine or contrivance, or from the smokestack or chimney of any such building or premises, or from any other source, except as hereinbefore authorized and permitted, shall be deemed guilty of a violation of this chapter and upon conviction thereof shall be fined not less than $10 nor more than $100 for each offense, and in addition thereto the violation of this chapter shall constitute disorderly conduct, and a person violating the same shall be deemed a disorderly person.
