As used in this article, the following terms shall have the meanings indicated:
ANIMAL
Any animal subject to rabies or other diseases of dogs.
BOARDING
The act of providing food and shelter to animals, regardless of whether it involves an overnight stay, for a fee, at the request of the owner or caretaker.
KENNEL
Any establishment where the business of boarding, selling or breeding animals for sale is carried on, except a pet shop.
PET SHOP
Any place of business that is not part of a kennel where animals, including, but not limited to, dogs, cats, fish, reptiles, rabbits, hamsters or gerbils, are kept or displayed chiefly for the purpose of sale to individuals for personal appreciation and companionship, rather than for business or research purposes.
POUND
Any establishment for the confinement of animals seized under the provisions of N.J.S.A. 4:19-15.16 or otherwise.
SHELTER
Any establishment where animals are received, housed and distributed.
A. 
Any person who keeps, operates or proposes to establish a kennel, a pet shop, a shelter or a pound shall apply to the Borough Clerk for a license entitling him to keep or operate such establishment.
B. 
Any person holding such license shall not be required to secure individual licenses for dogs owned by such licensee and kept at such establishments.
Any person who seeks to obtain a license for a kennel, a pet shop, a shelter or a pound shall file an application with the Borough Clerk on forms approved by the Clerk. The application shall describe the premises where the establishment is located or proposed to be located, the purpose(s) for which it is to be maintained, and shall be accompanied by the written approval of the Board of Health and the Zoning Officer showing compliance with local and state rules and regulations governing the location of and sanitation at such establishment.
A. 
All licenses issued for kennels, pet shops, shelters and pounds shall state the name and address of the licensee, the license number, the expiration date and the purpose for which the establishment is maintained, and shall contain the signature of the Borough Clerk and the seal of the Borough. Such licenses shall not be transferable to another owner or different premises.
B. 
All licenses shall expire on June 30 of each year. A renewal application shall be submitted to the Borough Clerk 30 days prior to the expiration date of the license.
All licenses issued for kennels, pet shops, shelters and pounds shall be subject to revocation by the Borough Council upon recommendation of the New Jersey Department of Health and Senior Services or the Borough Board of Health for failure to comply with the rules and regulation of the New Jersey Department of Health and Senior Services or the Borough Board of Health governing the same, after the licensee has been afforded a hearing either by the New Jersey Department of Health and Senior Services or the Borough Board of Health.
The annual license fee shall be $10 for kennels providing accommodations for 10 animals or less, $25 for kennels providing accommodations for more than 10 animals, and $10 for pet shops. No fee shall be charged for a shelter or a pound. All licenses fees shall be paid at the time the application is filed with the Clerk.
A license may be issued to a pet shop that permits the pet shop to sell pet supplies for all types of animals, including cats and dogs, and sell animals other than cats and dogs, but restricts the pet shop from selling cats or dogs, or both.
No person shall keep, operate or maintain a kennel, a pet shop, a shelter or a pound except in accordance with the requirements of N.J.S.A. 4:19-15.1, et seq. and N.J.A.C. 8:23-1.1, et seq., as may be amended from time to time.
The Borough Clerk shall forward to the New Jersey Department of Health and Senior Services a list of all kennels, pet shops, shelters and pounds licensed within 30 days after the licenses therefor are issued, which list shall include the name and address of the licensee and the kind of license issued.
