There shall be a Park and Recreation Commission to consist of
five Commissioners appointed by the City Council.
As used herein, the following terms shall be construed as follows:
The Park and Recreation Commission acting as a Commission.
All parks, commons and playgrounds owned, leased, operated
or maintained by the City of Laconia for use by the public.
The term of each Commissioner shall be three years and until
his successor is appointed and qualified. Two Commissioners shall
be appointed annually in March, except that every third year, one
Commissioner shall be appointed.
The Commissioners shall serve without pay and shall hold no
other municipal office.
Vacancies occurring by reason of death, resignation, extended
illness, removal or otherwise shall be filled by the City Council
for the duration of the unexpired term.
The Commissioners shall organize annually immediately after
the election of the members of their Board by the choice of one of
their members as Chairman and one as Clerk. The Clerk shall keep the
minutes of each meeting. The Commission shall meet monthly and at
the call of its Chairman.
A.
Parks. The improvement, care, regulation and general management of
the parks shall be vested in the Commission. The Commission may prescribe
such rules and regulations governing the improvement, care, regulation
and management of the parks as the City Council now has or may hereafter
have the right to make under the laws of this state, provided that
no contract or agreement for concessions shall be made in which the
cumulative consideration is greater than $200 or is in excess of seven
days' duration until such contract or agreement shall have been
formally ratified by vote of the City Council.
B.
Recreation. The Commission shall have the responsibility and power
to provide a recreational program for the citizens of the City of
Laconia.
C.
General. The Commission may, in its discretion, appoint a Recreational
Advisory Council to advise it in planning recreational activities.
The appointment, number, terms of office and duties of the members
of the Recreational Advisory Council shall be determined by the Commission.
The Commissioners shall not be eligible to serve as members of the
Recreational Advisory Council. The members of the Recreational Advisory
Council shall serve without pay.
All property granted, donated or bequeathed to the City of Laconia
in trust for parks or recreational purposes shall be held in trust
by the Trustees of Trust Funds, who shall apply the same through the
Commission for the purpose of such trust; provided, however, that
the income from the Napoleon Gale Fund for the enlargement and beautification
of the park located at the Laconia Public Library shall be turned
over to the Trustees of said Library, who shall apply the same for
the purpose of said trust.
A.
All sums of money realized from the parks, whether from rentals,
sales or material growing or being on the parks or otherwise, or realized
from the recreation program, whether as admission fees, donations,
sale of goods made as a result of the program or otherwise, shall
be paid to the City Treasurer.
B.
All sums of money appropriated by the City Council for recreation
programs and parks, and money from the Trustees of Trust Funds or
from any other source whatsoever shall, unless limited to another
use by the terms of a trust, be used, paid, laid out and expended
by the Commission in the improvement, care, regulation and general
management of the parks and for the benefit of the recreation program
and for no other purposes.
The Commission shall annually, on or before the first day of
July of each year, make a detailed report, in writing, to the City
Council of its acts and proceedings and of the condition of the parks
and the recreation program and an account of the receipts and expenditures
for the same and the funds subject to its order. The receipts, expenditures
and funds of the Commission shall be examined and audited by the City
Auditor.

Any person who violates any of the provisions of this chapter or who violates any rules and regulations adopted by the Commission pursuant to § 59-7 of this chapter shall be guilty of a violation, the penalty for which is not to exceed the sum of $100. Such person shall be deemed to be guilty of a separate offense for each and every day during any portion of which any violation of this chapter is committed, continued or permitted by such person and shall be punishable therefor as provided herein.
