No person shall operate a motorized scooter, other than a handicapped cart or a Segway, upon any sidewalk, street or public way within the City of Laconia.
A. 
Any person who violates any provision of this article shall be guilty of a violation punishable by a fine of $100 for the first offense, $200 for the second offense, and $300 for the third and subsequent offenses. Such person shall be deemed to be guilty of a separate offense for each and every day during any portion of which any violation of this article is committed, continued or permitted by such person and shall be punishable therefor as provided herein.
B. 
If any police officer of the City of Laconia has reasonable grounds upon which to base a belief that any person has violated the provisions of § 201-27 of the article, the Chief of Police shall be empowered to waive the requirement of Subsection A and in its place impound the motorized scooter for a period not to exceed seven days; provided, however, that any person whose motorized scooter is taken under this provision shall have a right at his or her option to have the matter of violation determined by the Laconia District Court.
