Editor's Note: This ordinance also changed the title of this
article from "Tri-Municipal Parks and Recreation Board" to "Parks
and Recreation Board."
The Township shall create a Parks and Recreation Board for the
management of Township parks. The Board shall be composed of not less
than five or more than nine members.
Members of the Board shall be appointed by the Board of Supervisors
in accordance with the following procedures:
A.
Board members shall serve for terms of five years, or until their
successors are appointed, except that the members first appointed
shall be appointed so that the terms of not more than two members
expire annually. All persons appointed shall serve their full terms
unless they voluntarily resign or are removed by the Board of Supervisors.
Vacancies occurring otherwise than by expiration of term shall be
for the unexpired term and shall be filled in the same manner as original
appointments.
B.
Whenever possible, due consideration will be given to representation
from various geographic sections within the Township, so that all
members shall not be from the same general area.
Members of the Board shall receive no compensation for their
services, but may be reimbursed by the Township for all expenses incurred
in performing their duties.
The Board is to be advisory and shall coordinate its activities
with the elected officials, Planning Commission, and other such local
governmental bodies.
The Board shall elect a chairperson, vice chair, and secretary
and select all other necessary officers to serve for a period of one
year. The Board may recommend rules and regulations for the conduct
of all business within its jurisdiction and exercise powers and functions
concerning parks and recreation facilities as may be delegated to
it by the Township.
The Board's power shall include:
A.
Identify the open space, recreation, park and trail needs of the
Township.
B.
Plan and supervise recreation programs approved by the Township.
C.
Recommend plans, programs, and policies regarding the provision of
recreation and park services at the park lands.
D.
Undertake recreation and park tasks as requested by the Township.
The Board shall keep minutes of its meetings, which it shall
submit to the Township. The Board shall submit an annual budget to
the Township, and an analysis of the adequacy and effectiveness of
community recreation areas, facilities, and leadership.

Potter Township, along with co-owners of the land, Gregg Township
and Centre Hall Borough, has established the Tri-Municipal Park, Inc.
(TMP) as a nonprofit corporation, for the development and ongoing
management of jointly owned land as a park for the benefit of the
citizens of these several municipalities. This article establishes
the continuing relationship between the TMP and Potter Township.
TMP is governed by a Board of Directors acting in accordance
with bylaws established by the Board of Directors and approved by
the three municipalities. The Board of Supervisors of each municipality
shall appoint up to three voting members on the Board of Directors,
one of whom must be an elected official, a Township Supervisor or
Borough Council member. Directors selected by the municipalities must
be residents of their respective municipalities and shall be appointed
as allowed for in the TMP bylaws for a period of not less than one
year.
An annual operating budget providing for ongoing park operations
and maintenance shall be provided by the TMP to the municipalities
for approval prior to the commencement of each fiscal year. The TMP
shall not in any manner obligate the municipalities for the payment
of any municipal funds until the same is appropriated by the municipalities.
Expenditures in excess of the approved operations and maintenance
budget are authorized, providing that the additional spending can
be funded by additional resources that the TMP may be able to obtain
through sources other than directly from the municipalities. In no
case may the TMP obligate the municipalities for more than 5% of the
annual operating budget without prior approval from the municipalities.
The following additional considerations apply:
A.
The Tri-Municipal Park is wholly within Potter Township and as such
is subject to any and all ordinances that exist within Potter Township.
B.
The Potter Township Parks and Recreation Board, as set forth in this Article I of this Chapter 60, shall coordinate activities directly with the TMP Board of Directors for planning and activities that logically apply to, or should encompass, all Township parks and recreational activities. Conversely, the TMP should endeavor to coordinate planned activities with the Parks and Recreation Board and with similar organizations that may be established by the other municipalities.
C.
Service without pay. Members appointed shall receive no compensation
for their services but may be reimbursed by the TMP for expenses incurred
in performing their duties.
D.
All persons appointed shall serve their full terms unless they voluntarily
resign or are removed by the Board of Supervisors. Vacancies occurring
other than by expiration of term shall be for the unexpired term and
shall be filled in the same manner as original appointments.
