This chapter shall be known and may be cited as the "Township
of Upper Burrell Driveway Ordinance" or just "Driveway Ordinance."
The purpose of this chapter is to regulate the location, design,
construction, drainage and maintenance of access to the Township's
roads and streets in such a manner as to not interfere or be inconsistent
with the design, maintenance and drainage of the roads or streets
of the Township.
A.
No person, partnership, corporation or any other type of entity shall
hereafter construct, build or establish any driveway, access road,
street, drainage facility, or structure connecting to or intersecting
with any portion of a Township road, drainage facility or within a
Township right-of-way without first obtaining a permit from the Township
of Upper Burrell for the construction, building or establishment of
the same.
B.
All permit applications shall be submitted in the name of, and be
executed by, the owner of the property or the owner's duly authorized
agent upon which the proposed driveway, access road, street, drainage
facility or structure is located. All permit applications shall be
submitted prior to the undertaking of any activity on the property
which the proposed driveway, road, street, drainage facility or structure
shall serve.
C.
All permit applications shall be submitted to the Secretary of the
Township of Upper Burrell. All such applications shall be reviewed
before issuance and an inspection shall be made of the plans and specifications
of the proposed construction in order to ensure that the same are
in conformity with all applicable ordinances of Upper Burrell Township
regulating and controlling the use and maintenance of Township roads
and rights-of-way and, further, to ensure that the driveway shall
be installed in accordance with the guidelines as established by the
Pennsylvania Department of Transportation and as set forth in the
Pennsylvania Code, Title 67, Transportation, Chapter 441, Access to
and Occupancy of Highways by Driveways and Local Roads, as amended
from time to time. Said inspections shall be made and subject to the
approval by the Township Engineer and/or the Township.
D.
The Township shall issue a driveway permit when it has been determined
that the construction and/or location of the new driveway or access
road will not violate any ordinance of Upper Burrell Township and
is in conformity with the standards set forth by the Pennsylvania
Department of Transportation as aforesaid.
E.
The Upper Burrell Township Board of Supervisors, upon recommendation
of the Township Engineer, shall deny the issuance of a driveway permit
if there are found to exist violations of ordinances of Upper Burrell
Township concerning the construction and/or location of such new driveway
or access road or if the proposed location fails to meet the minimum
standards as set forth by the Pennsylvania Department of Transportation
as aforesaid.
F.
All permit applications shall be executed by the owner/applicant,
shall include two sets of plans drawn to scale, detailing the location
and pertinent dimensions of the proposed activity and related Township
road and drainage features; and shall be accompanied by the permit
fee made payable to the Township of Upper Burrell in the amount as
hereinafter set forth in the schedule of permit fees.
