Any person who violates or permits a violation of this chapter
shall, upon conviction in a summary proceeding brought before a Magisterial
District Judge under the Pennsylvania Rules of Criminal Procedure,
be guilty of a summary offense and shall be punishable by a fine of
not more than $1,000, plus costs of prosecution. In default of payment
thereof, the defendant may be sentenced to imprisonment for a term
not exceeding 90 days. Each day or portion thereof that such violation
continues or is permitted to continue shall constitute a separate
offense, and each section of this chapter that is violated shall also
constitute a separate offense.
A.Â
If any person, partnership or corporation is determined by the Township
of Upper Burrell to be in violation of any of the conditions, restrictions,
or requirements of any permit issued pursuant to this chapter, or
any of the provisions of this chapter, then the Township shall, in
its sole discretion, be entitled to impose any or all of the following:
(1)Â
Require
the permittee to cease all work in the permitted area except the restoration
of the area to a safe condition or as otherwise provided in the provisions
of this chapter. If such activity is undertaken by the Township, then
no further work shall be performed in the permitted area until the
violation has been remedied.
(2)Â
Revocation of the applicant's permit.
B.Â
The Township of Upper Burrell shall have the right to enforce this
chapter or to remedy conditions occasioned by violations of the permit.
Any person, partnership, corporation or any other type of entity
aggrieved by any action of the designee of Upper Burrell Township
may appeal to the Board of Supervisors within 30 days of that action.
