By adoption of this chapter, the Town Board of the Town of Smithtown declares its intent to regulate in a manner consistent with the interests of the citizens of the Town of Smithtown the maintaining and operation of washing machines, drying machines and dry-cleaning machines. Unattended, such machines constitute a threat to the safety and welfare of the community. Therefore, recognizing the need for regulation, the Town Board of the Town of Smithtown does enact this chapter.
Each person who is the owner, operator or manager of a business of maintaining and operating for hire washing machines, drying machines and/or dry-cleaning machines for personal or individual use, where made available to the public, shall provide an attendant who is familiar with the operation of such machines installed on the premises used therein and who shall be in attendance at all times when such machines are made available for hire.
For the purpose of this chapter, the following terms shall have the meanings indicated:
FOR HIRE
Includes the making available of the washing machines, drying machines and/or dry-cleaning machines to any person for use by any means, requiring the payment of money by the insertion of coins or otherwise.
PERSON
Includes an individual, any combination of individuals or a corporation.
Any person, firm, association or corporation violating any of the provisions of any ordinance of the Town of Smithtown shall be guilty of an offense punishable by fine or imprisonment, or both; however, for the purpose of confirming jurisdiction upon courts and judicial officers, such violations shall be deemed to be misdemeanors, and for such purposes only all provisions of law relating to misdemeanors shall apply to such violations. Notwithstanding the foregoing, any person, firm, association or corporation violating any provisions of any ordinance of the Town of Smithtown shall be subject to a penalty in a sum not exceeding $50 for the first such violation and in a sum not exceeding $100 for any subsequent violation, said penalties to be recoverable in a civil action in the name of the Town of Smithtown as damages.
