As used in this Division A, the following terms shall have the meanings indicated:
APPOINTED EMPLOYEE
An appointed employee who is hired by the authority of law and who serves for an indefinite period of time and serves at the pleasure of an elected official.
CASUAL EMPLOYEE
An individual employed to work sporadically rather than regularly or for a fixed term who has no continuity of interest in terms and conditions of employment and has no right to expect the employment to continue and does not enjoy the benefits of a merit employee.
CLASSIFICATION PLAN
The listing of all established classes of work.
CLASS OF WORK
One or more positions which have similar duties, tasks and responsibilities, require the same minimum qualifications and have been assigned the same grade, salary range and title; also called "classification."
CLASS SPECIFICATION
A description of a class of work which summarizes the job, its essential functions and other duties, the required knowledge, abilities, and skills, minimum qualifications and other pertinent requirements. A class specification is generally descriptive of all positions assigned to the class of work, but not restrictive.
CONTRACTUAL EMPLOYEE
An individual employed under written agreement for a specific position. The agreement can, but is not required to, employ the individual for a specific length of time.
DEMOTION
The personnel action by which an employee, while continuously employed, is voluntarily or involuntarily changed to a position of a lower grade.
DEPARTMENT HEAD
The highest ranking official in each department and designated by the Mayor as a department head.
DETAIL
The official temporary assignment to an employee of all or part of the duties and responsibilities of another position in order to accommodate an emergency situation or a temporary disability.
ELIGIBILITY LIST
Those applicants qualified for employment for positions in a specific class of work.
EMPLOYMENT VERIFICATION
The process of verifying the identity of United States work eligibility of all persons selected for Town employment, including the presentation of qualifying documents at the time of hire and periodically thereafter in the case of aliens temporarily authorized to engage in United States employment.
EXEMPT EMPLOYEE
An employee exempt from the minimum wage and overtime requirements of the Federal Fair Labor Standards Act.
FULL-TIME EMPLOYEE
An employee intended to be employed for the total number of hours within the standard work week applicable to the position.
GRANT-FUNDED EMPLOYEE
An individual employed for an indeterminate period relative to availability of and/or interest in grant-funded programs. Full-time, grant-funded employees shall be required to serve a probationary period as set forth in the probationary status provision of this Personnel Ordinance.
MAYOR
The elected Mayor of Chesapeake Beach, Maryland or his or her successor.
MERIT EMPLOYEE
An employee hired for an indefinite period of the Town in accordance with the Town's merit selection system and subject to the terms and conditions of employment adopted by the Town Council for merit employees. Merit employees shall be required to serve a probationary period as set forth in the probationary status provision of this Division A. Contract, temporary, grant-funded, part-time, substitute, and seasonal appointees, and appointed officials are not selected under the Town merit system and are not covered by the rights and benefits of the Town merit system.
MERIT POSITION
A position which is currently held by a merit employee. Nothing herein requires a merit position to remain so designated as a merit position to be automatically converted to a non-merit position by the appointment of a non-merit employee to said position.
MINIMUM QUALIFICATIONS
A written description for each class of work which specifies the basic qualifications requisite for any employee to occupy and continue to occupy a position in that class of work.
NONEXEMPT EMPLOYEE
An employee who is covered by the minimum wage and overtime requirements of the Federal Fair Labor Standards Act.
OFFICE OF THE MAYOR
Those individuals hired by the Mayor to work in Town Hall and whose responsibilities include the administration of the Mayor's office, including but not limited to the administration of this Personnel Ordinance and the employee records required by this Division A.
PART-TIME EMPLOYEE
An hourly rated employee intended to be employed for less than the total number of hours within the standard pay period applicable to the position.
PAY PERIOD
One of 26 units of time comprising a pay year commencing on Monday 12:00 midnight and terminating the second following Sunday at 12:00 midnight for purposes of calculating salary to be paid to an employee.
PAY SCALE
A table of grades and corresponding salary ranges setting forth the compensation of employees who occupy positions in established classes of work.
PAY YEAR
A twelve-month period comprised of 26 pay periods beginning with the first day of the first full pay period and ending with the last day of the last full pay period for which wages are paid in a calendar year. A pay year may begin in one calendar year and end in another calendar year.
POSITION
A group of duties, tasks, and responsibilities allocated by the Mayor to a class of work and requiring the full-time or part-time employment of one person.
POSITION DESCRIPTION
An optional document reflecting duties, responsibilities and requirements which are specific to an individual position and fall generally within the scope of those contemplated for the class of work.
POSITION GRADE
An alpha or numeric rating assigned to position based on requirements and duties.
PROFESSIONAL EMPLOYEE
An exempt employee who performs work requiring advanced knowledge or teaching and consistent exercise of discretion and judgment, or work invention, imagination, and talent in a recognized field of endeavor.
PROMOTION
The personnel action by which an employee, while continuously employed, is competitively changed to a vacant position with a higher grade or by which an employee is hired in a classification designated as probationary or trainee and his or her position is noncompetitively moved to the next higher level in his or her classification series.
RECALL LIST
A list of individuals formerly occupying nonprobationary merit Town positions who were separated through a layoff action and who may be recalled in positions of the same or of a lower graded class of work in the class series than they previously occupied for which they are qualified.
RECLASSIFICATION
The personnel action by which a position and, if applicable, its incumbent are changed to a different grade or title as a result of a review of the responsibilities of the position.
SALARY RANGE
A set of pay rates for a grade, officially established and published, which begins at the minimum or base rate and continues through the maximum rate.
SALARY RATE
An employee's regular straight-time hourly rate of pay, exclusive of premium pay, upon which all personnel actions are based.
SEASONAL EMPLOYEE
An individual employed to fill a position for a periodic peak season.
SHIFT WORK SCHEDULES
The written schedules of the required daily hours of work constituting a work shift within a standard work week.
STEP
An adjustment to an employee's salary rate in accordance with the applicable pay scale.
SUBSTITUTE EMPLOYEE
An individual employed for a definite or indefinite period of time not to exceed 700 hours in a fiscal year. Substitute employees may be used to fill in when an employee is absent and coverage must be provided.
SUPERVISOR
An individual employee who is designated by a department head to supervise the work of other employees on either a routine or a per-assignment basis.
TEMPORARY EMPLOYEE
An individual employed for a period not to exceed 700 hours in a fiscal year. Temporary employees may be used when an emergency situation will not permit the filing of a position through the normal process, to fill in for an employee on leave, when additional help is authorized due to workload, or when the future of a position is uncertain.
TRANSFER
The personnel action by which an employee, while continuously employed, is changed to a position of the same grade and same or different title, or by which an employee and position are moved to a different unit of Town government.
VACANT POSITION
An authorized, budgeted position which has no incumbent.
WORK PERMIT
A certificate of eligibility for minors (ages 14 to 17) to be employed by the Town.
WORK WEEK
The standard number of hours an employee is scheduled to work in seven consecutive calendar days.
