Upon the approval of any subdivision within the Town of Chesapeake
Beach by the Planning and Zoning Commission, the closing or abandonment
of any paper streets or alleys within that subdivision come under
the following rules.
All street and alleys within the area covered by a plat and
not shown on the record plat shall be deemed closed and abandoned
as of the time of recording. The Mayor and Council have, by this section,
delegated to the Planning and Zoning Commission the power to determine
the propriety of street and alley closings. The power to close a street
or alley shall, nevertheless, be subject to the approval of all property
owners whose properties are served by a street or alley to be closed
and who must approve the closing by written consent under affidavit.
