[HISTORY: Adopted by the Board of Commissioners (now City Council) of the City of Atlantic City 8-31-1978 by Ord. No. 49-1978. (On July 1, 1982, the City of Atlantic City changed its form of government from a Board of Commissioners to a Mayor-Council in accordance with N.J.S.A. 40:69A-1 et seq. Therefore, all references to Board of Commissioners within this chapter have been changed to City Council.) Amendments noted where applicable.]

There is hereby created a Purchasing Board of the City of Atlantic City, consisting of six members as follows: the Purchasing Agent, the City Clerk, the City Engineer, the Affirmative Action Officer, one member of the City Solicitor's office and one member of the City Council of the City of Atlantic City or his designated alternate.
The Purchasing Board shall be authorized to receive such bids as may be presented and immediately proceed to unseal them and publicly announce the contents in the presence of the parties bidding or their agents, if they choose to be then and there present, and shall also make proper record of the prices and terms upon the minutes of the body.
A. 
The Purchasing Board shall keep full, complete and accurate minutes on all bids received and shall comply with the applicable provisions of state law.
B. 
All advertisements for bids under N.J.S.A. 40A:11-1 et seq., as amended, shall designate the time and place of the meeting at which the Board shall receive bids. Whenever possible, the advertisement for bids shall designate an hour for receiving bids between the hours of 10:00 a.m. and 3:30 p.m. from Monday through Friday, and no bids shall be opened previous to the hour designated in the advertisement, and none shall be received thereafter.
C. 
After the bids are received, read and recorded, they shall be turned over to the Purchasing Agent for tabulation and recommendation to the City Council.
The Purchasing Board herein established shall not be authorized to purchase materials and supplies pursuant to N.J.S.A. 40A:11-9, but shall exercise only those powers hereinbefore enumerated.
