A. 
The operator of any retail food establishment shall pay any required initial inspection fee and reinspection fee. There shall be annual inspections with the fees set forth below as calculated on the basis of square footage.

Submission of plans necessary for new construction or alteration to an existing recreational bathing facility. Plans shall be acted upon within 30 days. In the event plans are rejected or incomplete for more than more than 30 days, the plans must be resubmitted following initial submission procedures. Fees are to be calculated per each pool or spa.
A. 
A fee of $650 shall be charged for each initial plan review of any pool or spa.
B. 
A fee of $200 shall be charged for each required plan resubmission.
The fees for conducting a record search or making copies of inspection records shall comply with the Open Public Records Act, codified as N.J.S.A. 47:1A-1 et seq., as amended.

A. 
Seasonal pools shall be inspected at least twice per summer season at a cost of $175 per pool. Pools requiring a reinspection shall be charged a fee of $125 per reinspection.
B. 
Pools which are open for the entire year shall be inspected initially at least once. The fee for such inspection shall be $150. Reinspections of pools which are open year around shall be charged a fee of $150.
C. 
Spas shall be inspected on an annual basis. The fee for each initial inspection shall be $150. A reinspection fee of $150 shall be charged for each spa reinspection.

The fee for conducting inspections necessitated by underground storage tank closure shall be $250.

The fee for menu review and inspection of any temporary retail food establishments shall be $75.
B. 
The fee for inspection of any mobile retail food establishment shall be at a cost of $125.

C. 
Resubmissions.

(1) 
A fee of $500 will be charged for each plan resubmission requiring major modifications.
(2) 
For nonprofit organizations designated as a 501(c)(3) organization, a fee of $200 will be charged for each plan resubmission requiring major modifications.
D. 
Mercantile inspections without plan reviews for new owners.

E. 
Multiple establishments. For the purpose of this article, facilities with numerous establishments shall have each facility calculated individually.
F. 
Sale or transfer of establishment. Any sale or transfer of any establishment requires re-inspection. Such re-inspection shall be processed in accordance with the provisions of this article for an initial inspection.

In the event a business has been billed for health inspection fees, pursuant to §§ 170-38 through 170-44 of the within chapter, and said fees remain unpaid for more than 90 days, the City of Atlantic City shall revoke the business mercantile license of the delinquent business.
