GENERAL REFERENCES
Vehicles and traffic generally — See Ch. 243.
No person shall be permitted to park any vehicles on any public
street or portion thereof located in the following described zones
of the City of Atlantic City, for more than three consecutive hours,
unless:
A.
The vehicle is owned or operated on a regular basis by a City resident;
and
B.
The vehicle has a valid resident or special guest parking permit
displayed on the back of the rearview mirror in such a manner to be
readily examined by persons authorized to enforce this chapter.

A.
Residential parking permit zones shall be as follows:
(1)
Zone A. The area bounded by and between Albany Avenue, excluding
the easterly side of said street, to Jackson Avenue and the Boardwalk
to the inside thoroughfare; the westerly side of North Trenton Avenue
consisting of the 500, 600 and 700 Blocks; the easterly side of North
Trenton Avenue consisting of the 500 and 600 Blocks; the southern
most 400 feet of the westerly side of the 300 Block of North Trenton
Avenue; the southern most 185 feet of the easterly side of the 300
Block of North Trenton Avenue; the easterly side of North Maryland
Avenue consisting of the 100 Block.

The east side of Boston Avenue, between Atlantic Avenue and Pacific
Avenue.

Zone B.
(a)
The area bounded by and between Albany Avenue, excluding the
westerly side of said street, to Missouri Avenue (also known as "Christopher
Columbus Boulevard"), excluding the easterly side of the street, and
the Boardwalk, to the inside thoroughfare.
(b)
The east side of Bellevue Avenue, between the Boardwalk and
Pacific Avenue.

(c)
The west side of California Avenue, between the Boardwalk and
Pacific Avenue; eliminate limited parking on the east side of California
Avenue.

(d)
The east and west sides of Iowa Avenue, between Pacific and
Atlantic Avenues, except for the area on the west side of the street
between Atlantic Avenue and the Stenton Avenue access alley; provided,
however, that wherever parking has been restricted on the east side
of Iowa Avenue by previous ordinance or resolution presently in effect,
then said areas shall continue to be restricted parking areas as provided
in the ordinance or resolution, notwithstanding the provisions of
this section.

Zone C. The easterly side of Maryland Avenue between Atlantic Avenue
and Arctic Avenue (Grammercy Avenue), and both sides of Maryland Avenue
between Magellan Avenue and Brigantine Boulevard.

Zone C. The easterly side of Maryland Avenue between Atlantic Avenue
and Arctic Avenue (Grammercy Avenue), and both sides of Maryland Avenue
between Magellan Avenue and Brigantine Boulevard.

Zone C. The area bounded by and between New Jersey Avenue (both sides)
to New Hampshire Avenue (both sides), and from the Boardwalk to Pacific
Avenue, excluding Pacific Avenue, plus both sides of Oriental Avenue
from New Hampshire Avenue to the easterly end of Oriental Avenue.

Zone C. The easterly side of New Jersey Avenue between Arctic Avenue
(Grammercy Avenue) and Baltic Avenue (Madison Avenue); and the easterly
side of Connecticut Avenue between Arctic Avenue (Grammercy Avenue)
and Baltic Avenue (Madison Avenue); both sides of Baltic Avenue (Madison
Avenue) between New Jersey Avenue and Connecticut Avenue; and the
west side of Indiana Avenue between Mediterranean Avenue and Hummock
Avenue.

Zone C. The 100 block of Euclid Avenue from the Boardwalk to New
Hampshire Avenue, including residents of the unit block of South Maine
Avenue, 1700 Block of Mediterranean Avenue and the 1700 Block of Bacharach
Boulevard.

Editor's Note: This ordinance also provided for the redesignation
of former Subsection A(7) as Subsection A(8) and that appropriate
signs shall be posted in order to provide notice to the public of
the establishment of the permit parking area designated by this ordinance.
(9)
Wherever parking has been restricted in any portion of the above zones by another or other ordinances or resolutions presently in effect regulating parking (such as ordinances establishing metered areas), then said portions of the above zones shall continue to be regulated parking areas as provided in such respective other ordinances or resolutions, notwithstanding the provisions of this chapter. In addition, nothing in this chapter shall modify or repeal those restrictions imposed upon any hotel, motel or apartment complex required by the Municipal Zoning Ordinance, Chapter 163, Part 4, to provide the off-street parking for its guests or residents. Residents of hotels, motels or apartment complexes, where the Zoning Ordinance requires that the owners of said facilities provide off-street parking for its residents, shall not be entitled to receive residential parking permits pursuant to this chapter.
B.
Any person or persons issued a residential parking permit or a special
guest permit shall be issued such permit for a particular zone (i.e.,
Zone A, B or C), and such permit shall be used solely and exclusively
for parking in such respective zone.
Application for parking permits under this chapter shall be
made in writing to the Chief of Police or his designee upon such forms
as shall be prepared by the office of the Chief of Police upon passage
of this chapter.

Regular resident parking permits shall be granted to the following
persons under the terms and conditions as hereinafter set forth:
A.
To persons who are bona fide City residents of the City of Atlantic City of any zone described in § 202-2 above. Each said person shall be entitled to one parking permit for each vehicle owned or leased by such person and principally garaged at or near a residence located within any zone described in § 202-2 above.
B.
To each bona fide business establishment of the zone described in § 202-2 above. Each said business establishment shall be entitled to a maximum of 10 business employee parking permits, depending upon how many employees are actually employed and verification of their employment and of their necessity to utilize a motor vehicle for commuting to and from the business establishment.
Special guest permits shall be granted to the following person
or persons under the terms and conditions set forth above:
A.
Each bona fide resident household of the City of Atlantic City in zones described in § 202-2 shall be entitled to two special guest permits over and above any other permit they may be entitled to under this chapter if they reside within the residential parking permit zones established under this chapter under § 202-2 above.
Special guest permits may be used only by operators of vehicles within the area described in § 202-2 with the sole purpose of visiting a person or persons residing within the resident household to whom the special guest permit being displayed was issued. A special guest permit may be used by such persons for not more than three consecutive days. Special guest permits may be used only on streets located within two City blocks of the household to whom said special guest permit was issued.
An applicant for a regular residential parking permit or a special
guest permit shall show to the Chief of Police, or his designee, satisfactory
evidence that he or she fulfills all the conditions required by issuance
of said permit. Whenever, by reason of a change of circumstances,
any person, whether as an individual or member of a household, is
no longer qualified to hold any such permit, such permit shall immediately
surrender the same to the Chief of Police or his designee. It shall
be unlawful for any person to:
A.
Represent that he is entitled to a permit hereunder when he is not
so entitled, to display or cause to be displayed;
B.
In any way assist in the display of any special guest permit for
the parking of a vehicle by the operator for any purpose other than
to visit a person or persons residing in the household to whom the
special guest permit was issued by the City;
C.
Fail to surrender a permit to which he or she, or the household for
whom he or she obtained a permit, is no longer entitled;
There will be a fee of $1 for the first permit purchased and
$2 for each additional permit purchased. All permits issued hereunder
shall be valid for the current calendar year in which they are issued,
but may be renewed upon expiration, provided that the conditions for
issuance thereof still exist.
The Chief of Police is hereby directed to prepare and erect proper signs calling attention to the provisions of this chapter along those streets or portions thereof located within the area described in § 202-2 above.

A.
Any person who violates any provision of this chapter, except as
otherwise provided herein, shall, upon conviction, be punished by
a fine of up to $50, plus such costs in the amount of $25 and other
state imposed fees. Said penalties may be payable without Court appearance
in accordance with the Local Supplemental Violations Bureau Schedule
promulgated pursuant to New Jersey Court Rule R:7:12-4. A separate
offense shall be deemed committed each day during or on which the
violation occurs and/or continues.

B.
It shall be prohibited for any individual, corporation or other entity
to whom parking permits have been issued to duplicate, sell or lease
or otherwise transfer any pass in a manner not provided for in this
chapter. Any individual or business to whom a parking permit has been
issued that is found to have duplicated, sold, leased or otherwise
unlawfully transferred said parking permit will be subject to a fine
of $50 and/or imprisonment up to 30 days upon conviction. In addition,
all future parking privileges provided for in this chapter shall be
revoked for said individual or person.

C.
Any vehicles found to have parking permits which have been duplicated, sold or leased or otherwise unlawfully transferred shall be towed at the owner's expense. The owner of said vehicle shall receive a summons for a violation of this chapter and be subject to a penalty as provided in Subsection A above.
Residents of multifamily apartment or condominium apartment
buildings containing 10 or more units each, and which buildings contain
sufficient off-street parking facilities for all residents of said
buildings who desire off-street parking facilities, shall not be entitled
to regular residential parking permits.
The following vehicles shall be exempt from this chapter:
A.
Contractors, service and delivery vehicles. Contractors, service and delivery vehicles bearing the name and address of a commercial business and registered and licensed to do business in the City of Atlantic City, if required, and exhibiting commercial license tags may park without a permit between the hours of 8:00 a.m. and 6:00 p.m. during the time that the operator and/or occupants of said vehicle are actually rendering service, repairs or improvements to a residence or other property located within the area described in § 202-2 above. Any commercial vehicle parked overnight shall be deemed in violation of this chapter.
B.
Any vehicle lawfully parked in a parking space governed by a parking
meter, where the required coins have been deposited in said meter.
C.
Emergency vehicles. Emergency vehicles and public service, telephone
and other utility vehicles may park without a permit during the time
they are rendering service or repairs to the area. Proof of service,
e.g., an invoice or other written document must be furnished upon
request of an officer enforcing parking regulations. Any public utility
vehicle parked overnight and not providing service shall be deemed
in violation of this chapter.
D.
Vehicles of members of nonprofit organization(s).

Any member of the nonprofit organization seeking a permit qualifying his or her vehicle for exemption must complete an application pursuant to § 202-3.
(3)
Said application must be accompanied by a letter from the applicant
stating applicant's home address; name of the nonprofit organization
to which applicant is a member; local address of said nonprofit organization;
and the meeting dates and times of said nonprofit organization. Further,
the applicant must provide proof acceptable to the Chief of Police
or his designee as to the nonprofit status of the organization.
(4)
Any permit issued hereunder of this subsection shall be subject to the fees and renewal provision(s) of § 202-8.
(5)
Every successful applicant shall only receive one permit.
Every vehicle displaying a regular residential parking permit
or a special guest permit shall comply with all other applicable statutes,
ordinances, rules and regulations governing, regulating or restricting
the parking of motor vehicles on the public streets of the City of
Atlantic City. A vehicle displaying such permits shall not be exempt
from the obligation to deposit the required coins in parking meters
or to refrain from parking areas where parking is, restricted or prohibited,
including but not limited to loading zones, driveways, fire hydrant
areas, stop sign areas, etc.
A.
The Chief of Police is hereby empowered to promulgate reasonable
and appropriate rules and regulations to implement and provide for
the proper operation of this chapter.
B.
The Chief of Police is specifically given the authority to make reasonable regulations providing for the waiver of enforcement of this chapter for limited areas and periods of time for the purpose of permitting more than two guests of a resident of any zone described in § 202-2 to park for more than three hours for the purpose of attending a bona fide event (including but not limited to wedding receptions, funeral receptions, etc.) at the home of said resident, provided that such special events are not such events that are held frequently or on a regular recurring basis.[1]

City to preserve these areas for residential use; and
"Whereas, the legalization of casino gaming in Atlantic City
has significantly increased the number of employees and visitors traveling
to and from casinos, casino hotels, construction projects, and other
commercial enterprises, located in the areas of the City where casino
hotels and other commercial activities are present and permitted,
which casino hotels and other commercial areas are in many cases located
adjacent to or near residential areas of the City; and
"Whereas, as a result of said significant increase in the
number of persons traveling to and from the casino and commercial
areas of the City, many nonresident visitors and employees traveling
to and from the casino hotels and commercial areas of the City have
chosen to park their motor vehicles in streets in residential areas
of Atlantic City, thereby resulting in significant overcrowding of
streets in many residential areas of Atlantic City; and
"Whereas, the governing body of the City of Atlantic City
finds and declares it in the interests of the health, safety and general
welfare of the people of Atlantic City to implement a plan for discouraging,
limiting and restricting said vehicles operated by persons traveling
to and from casino hotels and other commercial areas of the City in
residential areas;
"Now, therefore, The Council of the City of Atlantic City
does ordain that:"
