Atlantic City, NJ Article IX Attachments to Trees

§ 222-74 Attachments prohibited; exceptions.

No object or thing shall be attached by any means to any tree, shrub or other planting which is in the City's right-of-way or upon City-owned property. This shall not include objects or things attached by authorized agents or employees of the City in the course of their employment or agency relationship with the City.

§ 222-75 Removal and impoundment of objects.

Any object or thing found so attached shall be detached from such tree, shrub or other planting and may be impounded by the City Police Department and shall not be returned to the owner until the fines or penalties established hereinafter for violation of this article have been paid or satisfied or a disposition of not guilty or a dismissal has been determined by a Judge of the Municipal Court.

§ 222-76 Disposition of impounded property.

Any property impounded by the Police Department pursuant to this article may be disposed of pursuant to N.J.S.A. 40A:14-157.

§ 222-77 Violations and penalties.

Any person or entity found in violation of the provisions of this article shall, upon conviction thereof in Municipal Court, be subject to a fine in a sum of not less than $25 nor more than $200.
