Any person or entity authorized to prune, cut or remove a tree located within the City's right-of-way shall give not less than seven days' written notice of the intention to exercise such authority to the owner of any residential or commercial property adjacent to the location of such tree. This requirement shall not apply to an emergency situation.

Any damage to the sidewalk or other infrastructure caused by the removal of a tree shall be repaired or replaced within 48 hours by the person or entity responsible for removal of such tree. In the event an owner of any residential or commercial property adjacent to the location of a tree requests the City to remove a tree adjacent to their property, and the City agrees to remove the tree, the City shall be responsible for the replacement or repair of the sidewalk or other infrastructure.

Any person or entity found in violation of the provisions of this article shall, upon conviction thereof in Municipal Court, be subject to a fine in the sum of not more than $2,000 or by imprisonment for a term not to exceed 90 days in the county jail or in any place provided by the City for the detention of prisoners, or both.
