A. 
There shall be provided for each premises disposable plastic bags or refuse containers with properly fitting lids sufficient in size and number to hold the refuse accumulating between collections.

(1) 
For all premises with 10 or fewer units, including residential and business establishments, refuse containers with properly fitting lids shall be required.
(2) 
For all premises with greater than 10 units, including residential and business establishments, refuse containers with properly fitting lids shall be required except where space constraints prevent the premises from doing so, and only in that case may disposable plastic bags be utilized, but shall be stored indoors between collections.
(3) 
All food and beverage service establishments, regardless of the amount of units on the premises, shall be required to utilize refuse containers with properly fitting lids.
B. 
In addition, every owner of a food service establishment, an establishment holding a retail consumption license issued by the State of New Jersey, Division of Alcoholic Beverage Control, or any nightclub or commercial building in which more than 25 individuals are regularly employed shall provide and maintain in good condition a cigarette litter receptacle which shall be located in any outdoor location where employees of the building are either pennitted to or do in fact smoke, provided that such a cigarette litter receptacle shall not be located less than five feet from any public entrance to the building. No commercial building owner shall be obligated to provide a cigarette litter receptacle if there is already such a receptacle located on public property within five feet of the location where the employees of the building are either permitted to or in fact smoke.

Disposable plastic bags shall be waterproof and capable of holding their contents without leakage, spillage or tearing. Disposable plastic bags containing refuse shall be kept securely sealed or tied so as to prevent leakage or spillage. Disposable plastic bags with rodent repellent shall be at least 1.1 mils thick whereas disposable plastic bags without rodent repellent shall be at least three mils thick.

Refuse containers shall have properly fitting lids connected to the container, shall be constructed of material capable of holding refuse without leakage or spillage, shall not be smaller than 10 gallons, and shall not weigh more than 50 pounds when full. Additionally, refuse containers shall be provided with handles so as to be suitable for collection by one person. The owners of multiple-dwelling homes shall provide adequate accommodation for all residents' deposit of garbage, ashes, and other refuse in refuse containers which meet the specifications of this section.
One of a variety of containers that are specifically designed to be used for the disposal of cigarette litter, typically consisting of an enclosed container with a wide base containing sand or other inflammable material, and a narrow neck above with a hole through which cigarette litter can be discarded and concealed from view.

All containers used for garbage, refuse, ashes, etc., shall have painted upon them, in figures at least six inches tall, the house or lot number for which such metal containers or cans are used and shall be enclosed with tight-fitting covers.
Refuse containers which do not conform to this chapter, or which have ragged or sharp edges or any defect likely to injure or hamper the person collecting their contents, shall be immediately replaced upon notice to the owner, tenant or occupant of the premises by any member of the Department of Public Works. The Director may authorize the garbage contractor to refuse collection of any container or plastic bag which weighs more than 60 pounds or which has not been replaced upon notice.

Refuse containers containing refuse shall be kept tightly closed with a properly fitting lid at all times, including when stored between collections or placed at the curb for collection.
No person may use a refuse receptacle, dumpster or demolition container for refuse storage or collection without the consent of the owner thereof.

Refuse receptacles shall be stored only in areas designated for storage between collections. They shall be placed adjacent to the curb in front of the premises or other area designated for collection no earlier than 7:30 p.m., except for addresses directly on Washington Street, which shall place receptacles no earlier than 9:00 p.m., and no later than 12:00 midnight on the day before collection and shall be promptly returned to the storage area upon collection, no later than 7:00 a.m. Refuse receptacles shall not be stored on the sidewalk in front of buildings or houses between collections.
The days scheduled for garbage collection will be advertised at the direction of the Director in at least one local newspaper, and, likewise, any change in such schedule will also be advertised in advance of such change or changes in at least one local newspaper.
Itinerant food peddlers shall provide refuse receptacles in readily accessible locations for the use of customers. Receptacles shall be emptied as often as necessary to prevent spillage of refuse and shall be removed upon changing locations.

All requests for an exception to any of the requirements set forth in this article shall be submitted in writing to the Director of Environmental Services. The determination as to whether to grant or deny the exception shall be in the sole discretion of the Director of Environmental Services or his or her designee.
