[Derived from Ch. I of the 1969 Revised General Ordinances]
For the purpose of the Code of the Borough of Spotswood, and
in the interpretation and application of all other ordinances heretofore
or hereafter adopted, except as the context may otherwise require,
the following terms shall have the meanings indicated:
The Business Administrator duly appointed pursuant to the
Charter and/or Acting Administrator serving in place of the Business
Administrator pursuant to the Charter or ordinance.
The Borough of Spotswood, in the County of Middlesex and
State of New Jersey.
Mayor-Council Plan "B" of Chapter 210 of the New Jersey Laws
of 1950, N.J.S.A. 40:69A-1 et seq., as amended and supplemented, and
any and all statutory provisions of the State of New Jersey as may
be lawfully applicable to the Borough.
The Municipal Clerk duly appointed pursuant to law.
The local legislative body of the Borough, constituted and
elected pursuant to the Charter.
An organization unit of the Borough government established
or designated by or pursuant to the Administrative Code as a department,
and any agency or instrumentality of the Borough government not allocated
or assigned within such an organization unit.
The head of a department.
The chief executive and administrative officer of the Borough
constituted and elected pursuant to law.
A calendar month unless otherwise specifically provided.
Any act of local legislation heretofore or hereafter adopted,
and including the Code of the Borough of Spotswood, so long as it
shall have been adopted by the procedure required for the adoption
of an ordinance and so long as it shall remain in force and effect
pursuant to law.
Any individual, natural persons, partnerships, joint ventures,
societies, associations, clubs, trustees, trusts, corporations or
unincorporated groups; or any officers, agents, employees, servants,
factors or any kind of personal representatives of any thereof in
any capacity, acting either for himself or for any other person, under
either personal appointment or pursuant to law.
Includes a street, avenue, road, alley, lane, highway, boulevard,
concourse, driveway, culvert, sidewalk and crosswalk, and every class
of road, square, place or municipal parking field used by the general
public.
A calendar year unless otherwise specifically provided.

For the purpose of the Code of the Borough of Spotswood and
any other ordinances heretofore or hereafter adopted, except as the
context may otherwise require:

The
present tense includes the past and future tenses, and the future
includes the present.
B.Â
The
masculine gender includes the feminine and neuter.
C.Â
The
singular number includes the plural, and the plural includes the singular.
D.Â
"Shall"
is mandatory and "may" is permissive.
E.Â
The
time within which an act is to be done shall be computed by excluding
the first and including the last day, and if the last day be a Sunday,
a legal holiday, or a day on which the offices of the Borough are
closed, that day shall be excluded.
F.Â
Whenever
a specific time is used in the Code of the Borough of Spotswood, it
shall mean the prevailing and established time in effect in the State
of New Jersey during any day in any year.
