A.
The Council shall appoint a Municipal Clerk for the term prescribed
and in accordance with N.J.S.A. 40A:9-133. Prior to his/her appointment,
he/she shall have been qualified by training and experience to perform
the duties of his office. He/she shall serve as Clerk of the Council
and have such other functions, power and duties as are provided by
the code.
B.
The Council may also appoint a Deputy Municipal Clerk to serve in
the absence of the Municipal Clerk. The Deputy Municipal Clerk shall
exercise all the powers of the Municipal Clerk and shall perform the
functions and duties of the office when required. The Deputy Municipal
Clerk shall assume all the duties of the Municipal Clerk in the absence
of the Municipal Clerk until such time as the Municipal Clerk shall
resume such duties.
The Borough Clerk, appointed by Council, shall:
A.
Keep the minutes and records of the proceedings of the Council, and
of any Council committee upon request of the Chairman of the committee.
B.
Preserve and compile all ordinances and resolutions, and at the close
of each year, with the advice and assistance of the Borough Attorney,
the Clerk shall compile, codify and bind all the ordinances and resolutions
then in effect, in conformity with the plan and system of the Code
of the Borough of Spotswood. The Clerk shall properly index the record
books, compilation or codification of ordinances and resolutions and
provide for their publication.
C.
Have custody of the Borough Seal, and affix it to such books, papers
and documents as may be authorized pursuant to law.
D.
Have and take custody of all official books, papers and documents
of the Borough for which no other repository is provided by Charter
or ordinance and preserve and keep them safely.
E.
Provide secretarial services for the Councilmen in the discharge
of their official duties.
F.
Issue certificates for local government or assessment searches pursuant
to state statutes and to charge and collect the fees as provided by
law, which fees are to be submitted to the Borough Treasurer.
The Borough Clerk also shall:
A.
Perform all of the functions required of municipal Clerks by the
general election law, N.J.S.A. 19:1-1 et seq., and any other state
law or Borough ordinance and receive for Borough use the fees prescribed
therefor.
B.
Perform such functions as are vested in the Borough Clerk by state
law and ordinances relating to bingo and raffles licensing, dog license,
liquor license, food handling, wrecker, taxi vending, amusements,
games, soliciting licenses.
C.
Have such other different and additional functions, powers and duties
as may be prescribed by law or ordinance or as assigned by the Council.
