This is an article to establish a yard waste collection and disposal program in the Borough of Swedesboro so as to protect public health, safety and welfare and to help reduce the solid waste tonnage into the area landfills, provide a recycling outlet for yard waste materials and to prescribe penalties for the failure to comply.

For the purpose of this article, the following terms, phrases, words and their derivations shall have the meanings stated herein unless their use in text of this article clearly demonstrates a different meaning. When not inconsistent with the context, words used in the present tense include the future, words used in the plural number include the singular number, and words used in the singular number include the plural number. The word "shall" is always mandatory and not merely directory.
CONTAINERIZED
The placement of yard waste in a trash can, bucket, paper bag or biodegradable bag (plastic bags prohibited), such as to prevent the yard waste from spilling or blowing out into the street and coming into contact with stormwater.
PERSON
Any individual, corporation, company, partnership, firm, association, or political subdivision of this state subject to municipal jurisdiction.
STREET
Any street, avenue, boulevard, road, parkway, viaduct, drive, or other way, which is an existing state, county, or municipal roadway, and includes the land between the street lines, whether improved or unimproved, and may comprise pavement, shoulder, gutters, curbs, sidewalks, parking areas, and other areas within the street lines.
YARD WASTE (VEGETATIVE MATERIALS)
Christmas trees, leaves, tree parts, branches, shrubs, stumps, bushes, hedge trimmings, weeds and grasses. Christmas trees shall be collected as is. Tree parts/branches and brush shall be tied and bundled in lengths no longer than four feet and weighting no more than 50 pounds. Branches, brush, logs, tree trunks and stumps larger than 12 inches in diameter are not collected. Clean wood and lumber is collected, provided they are cut in lengths no more than four feet and tied and bundled. No painted, stained, laminated or pressure treated wood is collected.
A. 
Sweeping, raking, blowing or otherwise placing yard waste that is not containerized at the curb or along the street is prohibited. If placement of yard waste occurs, the party responsible for the placement of the yard waste must remove the yard waste from the street and said party shall be deemed in violation of this article.
B. 
Leaves shall be placed in containers weighing less than 50 pounds when full or placed in large paper leaf bags/biodegradable disposable bags and placed at the curb for collection according to the yearly yard waste collection schedule.
C. 
The use of plastic bags is prohibited for yard waste containers.
The owner or occupant of any property or any employee or contractor of such owner or occupant engaged to provide lawn care or landscaping services shall not sweep, rake, blow or otherwise place yard waste, unless the yard waste is containerized, in the street. If the yard waste that is not containerized is placed in the street, the party responsible for placement of yard waste must remove the yard waste from the street or said party shall be deemed in violation of this article.
The provisions of this article shall be enforced by the Code Enforcement Officer, Police Department and or the Public Works Manager or his designee.
Any person(s) who is found to be in violation this article shall be subject to a fine not to exceed $1,000.
