The Borough Council may introduce and consider amendments to this chapter and to the Zoning Map, as proposed by a member of the Borough Council, by the Planning Commission, or by a petition of a person residing or owning property within the Borough, in accordance with Section 609 of the Planning Code.[1]

Petitions for amendment shall be filed with Borough Council, and the petitioner, upon such filing, shall pay a filing fee in accordance with a schedule established by the Borough Council. All Borough costs associated with §§ 280-58, 280-59 and 280-60 over and above the filing fee shall be borne by the applicant.
Any proposed amendment presented to the Borough Council shall be referred to the Planning Commission and Erie County Department of Planning for review prior to a public hearing by the Borough Council. A thirty-day review period by these planning agencies shall be allowed before the Borough Council may take final action on the amendment.
Before acting on a proposed amendment, the Borough Council shall hold at least one public hearing thereon pursuant to public notice.
A landowner in the Borough who desires to challenge on substantive ground the validity of this chapter or Map, or any provision thereof which prohibits or restricts the use or development of land in which he has an interest, may submit a curative amendment to the Borough Council with a written request that his challenge and proposed amendment be heard and decided as provided in Sections 609.1 and 609.2 of the Planning Code.[1] As with other proposed amendments, the curative amendment shall be referred to the Planning Commission and the Erie County Department of Planning at least 30 days before the public hearing is conducted by Borough Council.

Any resident or landowner in the Borough who is aggrieved by any decision of the Borough Council may, within 30 days after such decision of the Borough Council, appeal therefrom in accordance with Article X-A of the Planning Code.[1]
