All trash receptacles having a capacity of three cubic yards or more shall be maintained at a distance of no less than 15 feet from any building.

The regulation as set forth in this Part 1 shall apply to trash receptacles used in all zoning classifications of the West Norriton Township Zoning Ordinance (Chapter 27) with the exception of R-A Rural Residence Districts, R-1 Residence Districts and R-2 Residence Districts. Nonconforming uses of a commercial or industrial nature which lie in those residential districts excluded above shall be subject to the provisions of this Part 1.

Any person or corporation violating any of the provisions of this Part 1 shall forfeit and pay a fine or penalty of not less than $100 nor more than $600 to the Township. Such fine shall be collected by a summary proceeding before a District Justice, or recovered as debts of like amount are now recoverable by law, and in default of the payment of such fine and costs, shall be liable to imprisonment for not more than 30 days in the Montgomery County Prison.

Whenever a violator of this Part 1 has been notified by any of the duly authorized and constituted representatives of the Township, or by service of summons or prosecution, or in any other way, that such violator has committed a violation, each day that the violator continues in such violation shall constitute a separate offense punishable by a like fine or penalty.
