[HISTORY: Adopted by the Borough Council of the Borough of
Verona 8-31-2000 by Ord. No. 5-2000 (Ch. VII, Part 1, of the 1976 Code
of Ordinances). Amendments noted where applicable.]
A certain document, three copies of which are on file in the office of the Borough Secretary of the Borough of Verona, being marked and designated as "The BOCA National Fire Prevention Code, Eleventh Edition, 1999," as published by the Building Officials and Code Administrators International, Inc., be and is hereby adopted as the Fire Prevention Code of the Borough of Verona, Allegheny County, Pennsylvania, for the control of buildings, structures and premises as herein provided, and each and all of the regulations, provisions, penalties, conditions and terms of said BOCA National Fire Prevention Code are hereby referred to, adopted and made a part hereof as if fully set out in this chapter with the additions, insertions, deletions and changes, if any, prescribed in § 130-2 of this chapter.
The following sections of the Fire Prevention Code are hereby
revised as follows:

A.

Section F-1 01.1. Title.
|

These regulations shall be known as the "Fire Prevention Code
of the Borough of Verona," hereinafter referred to as "this code."

Section 112.3. Penalty for Violations.
|
|
Penalty for violations: Any person who shall violate any of
the provisions of this code or fail to comply with any order issued
pursuant to any section thereof shall be guilty of a summary offense
and, upon conviction thereof, shall be punished by a fine of not more
than $1,000 and/or imprisonment not to exceed 90 days, as provided
in the appropriate court for each offense. Each day that a violation
continues after due notice has been served shall be deemed a separate
offense.

Table F-107.2.3. A true and correct copy of a fully
completed Table F-107.2.3 is attached hereto, the terms of which are
incorporated herein.

The limits referred to in Section F-3003.2 of the BOCA National
Fire Prevention Code/1999, in which the storage of explosive materials
is prohibited, are hereby established as follows:
A.
In the R-1, R-2, R-3 and P Districts only, any inflammable liquids
shall be stored in a well-ventilated enclosed area. Any flammable
liquids, as aforesaid, shall be stored in approved containers which
meet all federal, state and local minimum laws, standards and requirements.
No person shall store any one container which exceeds five U.S. gallons,
nor shall any person store in all containers of flammable liquids
a maximum amount of which exceeds 10 U.S. gallons. Flammable liquids
shall be stored for personal use only.
B.
In the C and LM Districts only, underground tanks which contain any
flammable liquid are permitted as a conditional use only, provided
the following conditions are met:
(1)
Approval must be obtained from the Borough of Verona Council at a
properly held public meeting. All requests for approval of underground
storage tanks shall be submitted to the Borough of Verona Building
Inspector, who shall review said request and provide the Borough of
Verona Council with his or her recommendations, which are advisory
only and shall not be binding on Council.
(2)
All storage of gasoline and any other flammable liquids shall be
in well-ventilated underground tanks which meet or exceed all minimum
federal, state and local laws, regulations and standards.
(3)
All pumps or other aboveground service facilities shall be located
not less than 15 feet from any adjoining lot or street, roadway or
other public or private right-of-way or easement.
Nothing in this chapter or in the Fire Prevention Code hereby
adopted shall be construed to affect any lawsuit or proceeding impending
in any court or any rights acquired or liability incurred or any cause
or causes of action acquired or existing under any act or ordinance
hereby repealed as cited in this chapter, nor shall any just or legal
right or remedy of any character be lost, impaired or affected by
this chapter.
The Borough of Verona Manager shall certify to the adoption
of this chapter and cause the same to be published as required by
law, and this chapter shall take full force and be in effect 60 days
after the date of final passage and approval.
