Prior to any company, including utility companies, disturbing
any Borough street, alley or other such roadway or sidewalk, such
company shall post a ten-thousand-dollar bond which shall guarantee
that the roadway and/or sidewalk shall be restored to Borough standards
within 30 days of the date of the initial disturbance.
Any disturbed roadway and/or sidewalk shall thereafter be restored
to Borough standards, using approved materials, within 30 days. The
Borough shall be contacted immediately prior to placing a final surface
such as concrete or asphalt so that a code enforcement official or
other designated official may inspect the site to ensure that proper
approved materials have been utilized.
In the event that emergency conditions exist that preclude any
company from restoring any disturbed roadway and/or sidewalk, then
said company shall apply to the Borough for an extension of time and
show good cause as to why the roadway and/or sidewalk could not have
been restored within 30 days of its initial disturbance.
Failure to comply with this article and restore any disturbed
roadway and/or sidewalk within 30 days or any extended period of time
shall be cause for the bond to be forfeited to the Borough, which
then shall endeavor to restore the roadway and/or sidewalk to Borough
standards.
