This chapter may be cited as the "Tattoo and Body Piercing Establishment Code."
The following words and phrases when used in this chapter shall have the meanings ascribed to them by this section, unless the context clearly indicates otherwise:
ANTISEPTIC SOAP
An antibacterial liquid soap containing the active ingredient triclosan, or a medical soft soap made from vegetable oils and used especially in the treatment of skin disorders, known as "Green Soap."
AUTOCLAVE
An apparatus for sterilization, utilizing steam pressure at a specific temperature over a period of time.
BODY PIERCER
Any person who actually performs the work of body piercing.
BODY PIERCING
The process of breaching the skin or mucous membrane for the purpose of insertion of any object, including, but not limited to, jewelry for cosmetic purposes.
BODY PIERCING ESTABLISHMENT
Any building or room or portion thereof, including temporary structures, booths and mobile units, where body piercing is practiced or where the business of body piercing is conducted.
CLIENT
The person receiving a tattoo or piercing on or in his or her body as a personal service in return for compensation.
IMPLANTS
Any materials inserted entirely under the skin to create a raised surface area. This includes implants used in conjunction with tattooing.
INFECTIOUS DISEASE
A disease of man or animals resulting from a transmittable infection, whether or not patent, apparent, unapparent, latent, clinical or subclinical. Such diseases may include, but shall not be limited to, AIDS, the common cold, influenza, tuberculosis, scabies, impetigo, syphilis, chickenpox, measles, German measles, mumps, whooping cough, hepatitis, infection on hands or arms, sore throat, or jaundice of the skin or sclerae.
INFECTIOUS WASTE
Waste generated in the treatment or service of humans which falls under one or more of the following categories:
A. 
Human pathological waste, including tissues that are removed during medical procedures. The term does not include hair, nails or extracted teeth;
B. 
Human blood and body fluid waste, including liquid waste human blood, blood products, items saturated or dripping with blood or caked with dried human blood; and
C. 
Disposable instruments that have been in contact with infectious agents or that have been used in service to the client, including needles, scalpel blades, suture needles, and broken or unbroken glass or plastic ware.
MEDICATED OINTMENT
Bacitracin ointment or an equivalent antibiotic ointment in a base of white petroleum and light mineral oil containing 500 units of bacitracin.
OPERATOR
Any individual, firm, company, corporation or association that controls, operates, conducts or manages any tattoo or body piercing establishment, whether or not actually performing tattooing or body piercing.
PATHOGEN
A specific causative agent (as a bacterium or virus) of disease.
SANITIZATION
The process of reduction of the population of microorganisms to safe levels as determined by public health officials.
STERILIZATION
The process of destruction of microorganisms by physical or chemical means.
TATTOO ARTIST
Any person who actually performs the work of tattooing.
TATTOO ESTABLISHMENT
Any building or room or portion thereof where the work of tattooing is practiced or where the business of tattooing is conducted, or any part thereof, including temporary structures, booths and mobile units.
TATTOO or TATTOOING
The process of marking or coloring the skin of any person by the insertion of coloring matter under or in the skin so as to form indelible marks or figures.
A. 
No person shall engage in operating a tattoo or body piercing establishment within the corporate limits of the City without first having obtained a license to conduct such business from the Health Officer, in accordance with the provisions of this chapter. A license application may be refused and a license may be revoked or suspended summarily by the Health Officer, but such action shall be subject to review by the Harrisburg Board of Health.
B. 
Any person applying for a license to operate a tattoo or body piercing establishment shall include the following information on an application form available from the Health Officer:
(1) 
The name, address, date of birth and the trade name under which he or she will conduct business; if a corporation, its name, date, place of incorporation, address of its principal place of business and the names of its principal officers, together with their respective addresses and dates of birth; and if a partnership, association or unincorporated company, the names of the partners, owners and the managing officer or employee and their business and residence addresses and date of birth of each person identified;
(2) 
Method of sterilization to be utilized at the establishment, including a narrative and/or graphic explanation;
(3) 
The names, addresses and dates of birth of all employees;
(4) 
Any relevant criminal history of the applicant;
(5) 
A certificate from a physician duly licensed in the Commonwealth of Pennsylvania that the applicant and each employee named is free from infectious disease, including proof of vaccination of the employees for Hepatitis B;
(6) 
A history of any other tattooing or body piercing establishments operated by the applicant;
(7) 
A physical description and address of the tattoo or body piercing establishment;
(8) 
A valid City mercantile license clearly demonstrating compliance with the City Zoning Code;[1]

(9) 
One of the following:
(a) 
Proof of having previously held a tattooing or body piercing license; or
(b) 
Proof of having served an apprenticeship in tattooing or body piercing under an operator's license pursuant to this chapter for a period of not less than two years; or
(c) 
Proof of having done the work of tattooing or body piercing as a full-time occupation prior to the effective date of this Code; and
(10) 
A copy of annual certification in pathogen control training and procedures for all named employees.
C. 
A completed written application and an accompanying fee in the amount of $100 per establishment plus $75 per tattoo artist or body piercer, payable to the City Treasurer, shall be submitted to the Health Officer prior to any consideration for licensing.
D. 
An apprentice license fee of $50 per apprentice employee, payable to the City Treasurer, shall be submitted to the Health Officer annually.
E. 
A temporary special event license may be granted at the discretion of the Health Officer for a period of up to three days upon application from the operator and an accompanying fee of $25 per day per tattoo artist or body piercer.
F. 
A completed application for a license shall be reviewed by the Health Officer and the information provided therein verified. The Health Officer shall conduct a scheduled inspection of the proposed site and shall review the application and create a written report approving or denying the application. The Health Officer may include conditions as deemed necessary by him/her.
G. 
The licensee shall have five days after receipt of the notice to file a written request to the Board of Health for a hearing to review the Health Officer's determination.
H. 
Within 10 days of the receipt of such an application for a hearing, the Health Officer shall notify the licensee of the time and place of such hearing.
I. 
Licenses granted under this chapter shall be valid from the issuance date until December 31 of that year and shall be conditioned upon continued compliance with the provisions of this chapter as well as all applicable provisions of the City Public Health Code. The application fee shall be the fee calculated for a full year and shall not be prorated, regardless of when application is made.
All licenses granted under this chapter shall expire on the 31st day of December of each year. Written application for the renewal of a license, accompanied by a renewal fee in the amount of $100 per establishment plus $50 per tattoo artist or body piercer and $75 per apprentice, payable to the City Treasurer, must be presented to the Health Officer within 30 days before December 31st of each year. As a condition for renewal, the licensee shall update any information which has changed from the previous year's license. A late fee of $25 shall be paid in addition to the fee set forth above for any license renewal paid after the December 31 due date, and no establishment or individual shall operate without a renewal.
A new license and application fee shall be required whenever there is a change of ownership. Licenses are not transferable.
Licensees shall promptly notify the Health Officer upon any changes in personnel, and such notice shall be accompanied by the certificate required in § 6-329.3B(5). Such changes shall be reflected in the application document current at the time of the change.
A. 
The license required by this chapter shall be posted in a prominent and conspicuous area where it may be readily observed by clients.
B. 
Additionally, the holder of a license for operating a tattoo or body piercing establishment shall ensure that the following documents are posted in each such tattoo or body piercing establishment in a conspicuous and prominent place:
(1) 
Results of the most recent inspection of the premises;
(2) 
Pamphlets or literature explaining tattoo and/or body piercing aftercare;
(3) 
The name, address and phone number of the Health Officers;
(4) 
An emergency plan, including;
(a) 
A plan for the purpose of contacting the police, fire or emergency medical services in the event of an emergency;
(b) 
A sign at or adjacent to the telephone indicating the correct emergency telephone numbers;
(c) 
A plan for exiting the building in case of fire or other disaster; and
(d) 
The location of all hazardous material containers; and
(5) 
An occupancy permit issued by the appropriate municipal official for the tattoo or body piercing establishment.
A. 
All tattoo or body piercing establishments shall be inspected at least twice annually with a minimum of three months between inspections. The Health Officer or any other authorized City employee authorized by the Director of the Department of Building and Housing Development or his/her designee may conduct periodic inspections of any tattoo or body piercing establishment for the purpose of determining that such operator and the establishment are in compliance with all provisions of this chapter.
B. 
If an applicant fails an inspection, a cease and desist order shall be issued immediately by the Health Officer. Applicant shall pay a reinspection fee of $100 for each reinspection, and said reinspections shall not count toward the minimum two annual inspections.
C. 
It shall be unlawful for any person or operator to willfully prevent or restrain any City official from entering any tattoo or body piercing establishment for the purpose of inspecting said premises after proper identification is presented to the operator.
A. 
The Health Officer may revoke the license granted under this chapter whenever it appears that the licensee or his or her agents or employees are operating the tattoo or body piercing establishment in violation of this chapter or in such a manner so as to be a threat to the public health or safety.
B. 
The Health Officer shall notify the licensee of the intention to revoke the license. The notice shall be in writing, signed by the Health Officer, and shall set forth findings of fact and the grounds on which the revocation is based. Said notice of such determination shall be delivered to the licensee either in person or by registered or certified mail to the place of business of the tattoo or body piercing establishment.
C. 
The licensee shall have five days after receipt of the notice to file a written request to the Board of Health for a hearing to review the Health Officer's determination.
D. 
Within 10 days of the receipt of such an application for a hearing, the Health Officer shall notify the licensee of the time and place of such hearing.
E. 
There shall be a fee of $40 for the reinstatement of any revoked license.
When it is determined by the Health Officer that the operation of the tattoo or body piercing establishment poses an immediate and imminent threat to the public health and safety such that irreparable harm will occur if the tattoo or body piercing establishment is not immediately closed, the Health Officer shall have the power to order the immediate closure of such establishment until such time that the violations have been corrected or by order of the Board of Health.
A. 
All tattoo and body piercing establishments shall have a storefront and a readily visible sign prominently identifying the location as such, in compliance with applicable Zoning Code requirements.
B. 
All tattoo and body piercing establishments shall have an area of not less than 100 square feet and shall be completely separated by solid partitions or walls extending from floor to ceiling from any food establishment, any room where food is prepared or any room used for human habitation. If such partition or wall contains a door, such door shall be self-closing and kept closed.
C. 
Floors shall be constructed of materials so as to be durable, easily cleaned and impervious to liquids and shall be kept clean and in good repair. The juncture between the floor and the wall shall be coved. The floor shall be swept and wet-mopped on a daily basis with a ten-percent solution of bleach or a commercial disinfectant. Such wet-mopping shall immediately occur in the event that bodily fluids or other pathogens come into contact with the floor.
D. 
Walls, partitions and ceilings in areas where tattooing and/or body piercing is conducted shall have an impervious, smooth and washable finish and shall be kept clean and in good repair. Tables, cabinets, shelves, drawers, furniture, fixtures, and all other equipment and appurtenances shall have an impervious, smooth and washable finish in a light color that will not conceal the presence of soil and shall be kept clean and in good repair.
E. 
Each establishment shall have an area that will be screened from public view for customers requesting privacy or for all genital body art procedures. Dividers, curtains or partitions, at a minimum, shall separate multiple body art stations.
F. 
Each tattoo and body piercing establishment shall contain a sink for the exclusive use of the tattoo artists in which to wash their hands and a devoted sterile station for the ultrasonic cleaner, autoclave, and wash basin. All facilities, containers, and wash basins used for the cleaning of tools and instruments or for hand washing shall be provided with hot running water from an approved source at a temperature of not less than 110° F., but not greater than 125° F., and cold running water at all times when the establishment is open for service. Any wash basin used for the cleaning of tools and instruments shall be used exclusively for that purpose and not for other materials unless said materials are able to be autoclaved.
G. 
Hair particles, paper, tissues, cotton, and other waste materials shall be disposed of and kept stored in tightly covered containers and removed from the premises not less than two times a week. Refuse containers in areas where services are provided to clients shall be emptied and cleaned daily. All refuse containers shall be constructed from a material which is impervious to liquids and shall be kept clean. Items contaminated by blood or other body fluids shall be separated from general waste and properly disposed of in accordance with the rules and regulations of the Pennsylvania Department of Environmental Protection at 25 Pa. Code Chapter 285. All needles should be properly disposed of in an appropriate biohazard container.
H. 
All tattoo and body piercing establishments shall provide toilet facilities which comply with the requirements set forth in the Plumbing Code.[1]

A. 
Domestic or wild animals shall not be present in any part of the establishment at any time. The term "domestic or wild animals" includes, but is not limited to, dogs, cats, birds and reptiles.
B. 
Insects and rodents shall not be present in any part of the establishment at any time. The operator shall take effective measures against insects' and rodents' entrance into, breeding on or presence in the premises. Evidence of insect or rodent infestation shall be cause for immediate closure of the establishment by the Health Officer.
A. 
Before working on a client, each operator, tattoo artist or body piercer shall thoroughly wash and scrub his or her hands with hot water and an approved antiseptic soap and shall allow his or her hands to air-dry by mechanical or nonmechanical means. Appropriate gloves must be worn as indicated in § 6-329.14T of this chapter.
B. 
Each operator, tattoo artist or body piercer shall keep his or her outer garments clean at all times during business hours and shall be clean in person.
C. 
Performing tattooing or body piercing while under the influence of alcohol, narcotic drugs, stimulants, or depressants is prohibited.
D. 
There shall be no smoking in tattoo or body piercing establishments.
E. 
No food or beverage shall be consumed in the area where tattooing and/or body piercing is performed.
F. 
No person, including the operator, artist and/or client, with any infectious disease or suspected of having such disease shall engage in tattooing or body piercing.
A. 
After each tattooing operation, the tattoo tubes and tips shall be placed in an ultrasonic-type machine to remove excess pigment from the tubes. When this process is completed, the tubes shall be removed from the ultrasonic cleaner, rinsed and placed in a self-indicating autoclave packet, dated and sealed in preparation for autoclaving. Needle bars shall be disposed of in an approved biohazard container.
B. 
All needle bars, grips and tubes shall be sterilized in an autoclave under a pressure of not less than 15 pounds per square inch for not less than 30 minutes at a temperature not less than 250° F. after each use and before reuse. Temperature-sensitive autoclave tape or any other temperature-sensitive medium approved for autoclaves by the Health Officer must be applied to each load every time the autoclave is used. Autoclave operation to assure sterility must be tested monthly using a biological indicator, such as spore strips or spore suspensions. Records documenting the specific results of such tests must be maintained by the operator for not less than two years.
C. 
A set of individual, single-service sterilized needles shall be used for each new client. Following sterilization, if not immediately used, the needles shall be stored in an approved germicidal solution. The open end of the needle tube of the tattooing machine shall be cleaned and sterilized in an approved manner before each use. Sterilization shall be done by one of the following methods:
(1) 
By holding in an approved autoclave for not less than 30 minutes at 15 pounds per square inch pressure at 250° F.; or
(2) 
By immersing in an approved germicidal solution for not less than 30 minutes.
D. 
No rusty, dull or faulty needles shall be used for tattooing.
E. 
Sterile instruments shall be stored in a glass or metal cabinet which is enclosed on all sides and maintained in a sanitary manner at all times.
F. 
Needles and instruments shall be used, handled, and temporarily placed on a sanitary disposable surface barrier, such as a dental bib or drape sheets, during tattooing so that they are not contaminated.
G. 
Any machines, power supplies, armrests, clip cords, wash bottles, or items not sterilized by autoclave operation, but used in conjunction with tattooing, shall be covered with a surface barrier.
H. 
All bandages, surgical dressings, gauze, tissues, towels, and any other materials, instruments or equipment used in the preparation and tattooing of a client shall be sterile at all times.
I. 
All products applied to the skin, such as but not limited to body art stencils, applicators, gauze and razors, shall be single use and disposed of in an appropriate and safe manner.
J. 
Immediately before applying a tattoo, the quantities of pigment required for the tattoo shall be transferred from the pigment bottles and placed into sterile, single-use plastic containers. Upon completion of the tattoo, these containers shall be discarded.
K. 
Only distilled water or witch hazel shall be used to dilute pigment, if such dilution is necessary.
L. 
A written inquiry of the medical history of the client shall be made by the operator or artist prior to tattooing. Persons reporting a history of infectious disease or any blood thinning medication shall not be tattooed.
M. 
No tattooing or body art shall be performed on someone who visibly appears to be under the influence of alcohol, narcotic drugs, stimulants, or depressants.
N. 
No tattooing shall be done on skin surfaces which have any rash, pimples, boils, infections, or any other evidence of an unhealthy condition, or preexisting conditions such as psoriasis.
O. 
The tattooed skin area, which must be shaved, must first be washed with warm water and an approved antiseptic soap. A safety razor with a new, single-service blade for each client shall be used for preparation of the area to be tattooed. The blade shall be discarded after each use, and the blade holder, if reused, shall be autoclaved after each use. After shaving, the area to be tattooed shall be thoroughly scrubbed with warm water and an approved antiseptic soap for not less than two minutes and wiped with a sterile gauze pad soaked in a seventy-percent alcohol solution.
P. 
Following the cleansing of the client's skin, the tattoo operator or artist shall again wash and scrub his or her hands in the manner prescribed in § 6-329.13A.
Q. 
Ointment such as petroleum jelly, used for the lubrication of stencils, shall be in a single-service, collapsible tube and shall be applied on the area to be tattooed with sterile gauze, or if applied by hand, latex or nitrile gloves must be worn. The collapsible tube and gauze shall be used only once and then properly discarded.
R. 
The tattoo artist shall maintain a sterile field throughout the tattooing process.
S. 
As the tattoo operation progresses, any excess pigment applied to the skin shall be removed with sterile gauze, sterile cotton, or sanitary paper towels which shall be discarded after each use. The use of styptic pencils, alum blocks or other solid styptics to check the flow of blood is prohibited.
T. 
Latex or nitrile examination gloves shall be worn by the tattoo artist when having physical contact with a client. The artist must also wear latex or nitrile gloves when removing ink caps, razors, or any other equipment necessary for use in the tattooing process from their containers. Gloves shall be used only once and then properly discarded. The gloves must meet or exceed standards imposed by the United States Food and Drug Administration.
U. 
Sterile sponges or disposable paper tissue shall be used during any procedure. Once a sponge or tissue comes in contact with a client's skin, it shall be disposed of in an appropriate and safe manner, and a new sterile sponge or tissue shall be used for any subsequent single contact.
V. 
After completion, the tattooed area shall be wiped clean with sterile gauze or sanitary paper towels. The tattooed area shall be allowed to dry, and salve from a collapsible, single-use tube shall be applied using sterile gauze. The tattooed area shall be covered by a nonstick bandage or sterile gauze, attached with an approved adhesive. Clients should be instructed to continue to apply the ointment and, if necessary, to cover with a nonstick bandage, as directed.
W. 
Once the tattooing process is completed, the workstation and any nonautoclavable items that were used in the procedure or subject to contamination during it must be sterilized.
X. 
The operator or tattoo artist shall provide verbal and written instructions to the client for care of the tattooed area to prevent infection and allergic reactions, including instructions to consult a physician or hospital emergency room for further evaluation and treatment in case of suspected infection. These instructions shall contain the name, address and telephone number of the tattoo establishment.
The use of implants is strictly prohibited.
A. 
After each body piercing operation, the insertion tapers, forceps, nostric tubes, needle receiving tubes, ring expanding and closing pliers, files, etc., shall be placed in an ultrasonic-type machine to remove any foreign material. When this process is completed, the instruments shall be placed in individual autoclavable containers, dated and sealed in preparation for autoclaving.
B. 
All needles, clamps, pliers or other equipment and all used jewelry shall be sterilized in an autoclave under a pressure of not less than 15 pounds per square inch for not less than 30 minutes at a temperature not less than 250° F. after each use and before reuse. If not purchased presterilized, all corks, rubber bands, hair clips, wooden-handled cotton swabs, toothpicks, gauze pads and other single-use items are also to be autoclaved prior to use. Temperature-sensitive autoclave tape or any other temperature-sensitive medium approved for autoclaves by the Health Officer must be applied to each load every time the autoclave is used. Autoclave operation to assure sterility must be tested monthly using a biological indicator such as spore strips or spore suspensions. Records documenting such tests must be maintained by the operator for not less than two years.
C. 
Sterile instruments shall be stored in a glass or metal cabinet which is enclosed on all sides and maintained in a sanitary manner at all times.
D. 
Needles and instruments shall be used, handled and temporarily placed on a sanitary disposable surface barrier, such as a dental bib or drape sheets, during body piercing so that they are not contaminated.
E. 
Any machines, power supplies, armrests, clip cords, wash bottles, or items not sterilized by autoclave operation, but used in conjunction with piercing, shall be covered with a surface barrier.
F. 
All bandages, surgical dressings, gauze, tissues, towels, and any other materials, instruments or equipment used in the preparation and piercing of a client shall be sterile at all times.
G. 
All products applied to the skin, such as but not limited to body art stencils, applicators, gauze and razors, shall be single use and disposed of in an appropriate and safe manner.
H.

K. 
The area to be pierced shall be prepared for not less than 30 seconds with individual packets of povidone-iodine or scrubbed with a sterile gauze pad soaked in a seventy-percent alcohol solution.
L. 
Following the cleansing of the client's skin, the body piercer shall again wash and scrub his or her hands in the manner prescribed in § 6-329.13A.
M. 
Only medical grade markers or ink and sterile toothpicks are to be used to identify the areas to be pierced. Gentian violet may be utilized for marking oral piercings.
N. 
The use of styptic pencils, alum blocks or other solid styptics to check the flow of blood is prohibited.
O. 
In no instance shall ear piercing guns or similar devices be used for piercing any part of the body other than earlobes.
P. 
The operator or body piercer shall maintain a sterile field throughout the piercing process.
Q. 
Latex examination gloves shall be worn by the operator or body piercer during any procedure that involves contact with a client's blood. The person performing the piercing must also either wear latex or nitrile gloves or use autoclavable tongs when removing jewelry, or equipment used in conjunction with piercing, from their containers. Latex or nitrile gloves shall be used only once and then properly discarded. The gloves must meet or exceed standards imposed by the United States Food and Drug Administration.
R. 
The operator or body piercer shall direct the client to assure that appropriate jewelry material, sizes and styles are selected. Inferior jewelry, such as that which is damaged, scratched, intended for earlobes or not expressly designed for body piercing, or that made of silver or other corrosive metal or gold plated or gold filled shall not be used. Sterilized jewelry not in an individually sealed container is to be sterilized by autoclave immediately prior to use.
S. 
Piercing needles shall be single service and not reused.
T. 
Individuals other than the certified operator(s) or body piercer(s) are prohibited from conducting body piercing in the establishment.
U. 
After completion, the pierced area shall be wiped with sterile gauze saturated with an approved antiseptic solution or a seventy-percent alcohol solution and allowed to air dry.
V. 
Once the piercing process is completed, the workstation and any nonautoclavable items that were used in the procedure or subject to contamination during it must be sterilized.
W. 
The operator or body piercer shall provide verbal and written instructions to the client for care of the pierced area to prevent infection and allergic reactions, including instructions to consult a physician or hospital emergency room for further evaluation and treatment in case of purulent drainage or suspected infection. These instructions shall contain the name, address and telephone number of the body piercing establishment.
A. 
The operator of a tattoo or body piercing establishment shall maintain written records of all clients to whom the operator has provided service. These records shall indicate the following:
(1) 
The name, address, telephone number, age and signature of the client.
(2) 
The date the procedure was performed.
(3) 
In the case of tattoo establishments:
(a) 
A description of the tattoo which includes, but is not limited to, its location on the client's body, its design or pattern, and the colors utilized; and
(b) 
The name and license number (granted under this chapter) of the tattoo artist who administered the tattoo.
(4) 
In the case of body piercing establishments:
(a) 
A description of the piercing which includes, but is not limited to, its location on the client's body and its material, size and style; and
(b) 
The name and license number (granted under this chapter) of the body piercer who administered the piercing.
B. 
A record of each complaint, reaction, infection, or other similar event shall be maintained in written form by the operator and submitted to the Health Officer within 24 hours of notification by the client. Such records shall be entered in ink in a bound book kept solely for this purpose, which book shall be made available at reasonable hours for examination by the Health Officer or any law enforcement officer. Such records shall be preserved for not less than two years from the date of the last entry therein.
C. 
Autoclaving test records shall be maintained as indicated in § 6-329.14B.
A. 
No operator shall administer a tattoo to or pierce the body of any person under the age of 18 years unless the parent or legal guardian of such minor has given written permission and the parent or legal guardian is present at the time of the tattooing or piercing.
B. 
Consent forms for persons under the age of 18 must be kept for four years.
All operators, tattoo artists and body piercers shall follow the appropriate manufacturer's standards concerning the proper use of machinery and instruments.
A. 
Physicians duly licensed by the Commonwealth of Pennsylvania who utilize tattooing or body piercing procedures as part of their practice are exempt from these regulations.
B. 
Individuals who pierce only earlobes are exempt from these regulations when it is demonstrated to the Health Officer that equipment, supplies or jewelry that come into contact with the client's earlobe are sterile and that the operators' hands that come into contact with equipment, jewelry or the client's skin surface are clean and have been wiped with alcohol.
A. 
Any person who violates the provisions of this chapter shall be subject to Chapter 6-103, Enforcement and Penalty, of these Codified Ordinances.[1]

B. 
Upon conviction for a violation of any provision of this chapter pursuant to Subsection A, in addition to any fines, fees or penalties levied in accordance with Subsection A, an additional neighborhood mitigation penalty shall be levied in the amount of $25. All such penalties levied and collected by any division of the Unified Judicial System existing under Section 1 of Article V of the Constitution of Pennsylvania and 42 Pa.C.S.A. § 301 shall be remitted to the City for deposit into the Neighborhood Mitigation Fund for the purpose of funding mitigation exercises performed by the City on private properties, including but not limited to demolitions, cleanups, clean and seals and light repairs. If the fine is paid on installments, the proportionate amount of the neighborhood mitigation penalty shall be remitted on each installment.
