An appointed Superintendent of Public Works shall be certified by the State of New Jersey as a Certified Public Works Manager and have such other certificates, licenses and permits required by state law and regulations and municipal ordinances.
A. 
The Superintendent of Public Works shall serve until January 1 next succeeding the date of appointment and until a successor has qualified.
B. 
Pursuant to N.J.S.A. 40A:9-154.5 and 40A:9-154.6, the position of Superintendent of Public Works, also known as "Principal Public Works Manager," "Municipal Superintendent of Public Works" or "Director of Public Works," is hereby granted tenure. Pursuant to the definition of "Municipal Superintendent of Public Works" provided in N.J.S.A. 40A:9-154.5, a person holding office, position or employment as the full-time Municipal Superintendent of Public Works who has held the office, position or employment continuously for five years or more shall continue to hold the office, position or employment, notwithstanding he is serving for a fixed term, during good behavior and efficiency, and shall not be removed therefrom for political or other reasons except for good cause, upon written charges filed with the Chairperson of Public Works and after a public, fair and impartial hearing.
The Township of Ocean is desirous of streamlining its departments and personnel responsible for maintenance and upkeep of public roads, parks, docks, and other facilities into one department, instead of two as it is currently configured. The purpose of this chapter is to combine the Road Department and Department of Parks by creating a new Department of Public Works and designating same as Chapter 2.33, while simultaneously repealing and deleting Chapters 2.32 and 2.104.[1]

The Department of Public Works shall consist of, but not be limited to, the following personnel:
A. 
Supervisory staff to be appointed by the Township Committee by resolution as deemed necessary and subject to appropriations in the current year budget.
(1) 
Foreman, Department of Public Works.
(2) 
Foreman, Department of Utilities.
The Department Head shall be the custodian of all tools, equipment and vehicles and property belonging to the Township of Ocean and not assigned to the care of the Township or any other public office. The Department Head shall establish rules and regulations for proper storage of tools, equipment and vehicles.
