The Borough of Doylestown accepts the conveyance of all the
real and personal property of the trustees of the Fanny Chapman Swimming
Pool, in trust, as set forth in the Decree of the Orphans' Court
of Bucks County aforesaid.

The swimming pool shall henceforth be known as the "Fanny Chapman
Swimming Pool."

The management and operation of the Fanny Chapman Swimming Pool
shall be vested in a board to be known as the "Board of Managers of
the Fanny Chapman Swimming Pool." The Board shall have authority,
subject to approval by Borough Council:
1.
To employ and discharge supervisors, caretakers, instructors, guards
and other personnel necessary or proper to conduct a swimming pool
and provide swimming and aquatic instruction.
2.
To fix the salaries of all employees.
3.
To establish admission charges.
4.
To promulgate and enforce reasonable and proper rules for the use
of the pool and the grounds surrounding it and formerly owned by the
Trustees in order to ensure the health and safety of the public and
the conduct of the program of instruction.
5.
To establish a schedule of hours when swimming shall be permitted.

The Board of Managers of the Fanny Chapman Swimming Pool shall
consist of not more than nine nor less than seven regular members
who shall serve for terms of three years, or until their successors
are appointed by resolution of Borough Council and one student member
to be appointed by resolution of the Borough Council. No regular member
of the Board of Managers shall serve more than two consecutive three-year
terms and thereafter shall be ineligible to serve for an interval
of at least one year.
Every member of the Board of Managers, including the student
member, shall be a resident of the Borough of Doylestown or of a municipality
within the Central Bucks School District; provided, however, that
at all times the majority of the regular members of the Board of Managers
shall reside within the Borough of Doylestown.
All members of the Board of Managers shall serve without compensation.
The regular members of the Board of Managers shall elect a Chairman,
Secretary and any other necessary officers who shall serve until the
31st day of December next following their election.
The student member so appointed shall, at the time of appointment,
be between 15 and 18 years old and shall at all times be a resident
of the Borough of Doylestown and be enrolled in and actively attending
an accredited high school program and be in his/her freshman, sophomore
or junior year in such high school program. The student member so
appointed shall serve for a term of one year extending, if appointed
as a freshman from the month of May in his/her freshman year through
the month of April in his/her sophomore year, if appointed as a sophomore,
from the month of May in his/her sophomore year through the month
of April in his/her junior year or, if appointed as a junior, from
the month of May in his/her junior year through the month of April
in his/her senior year. The student member shall be permitted to attend
all meetings of the Board and shall be permitted to participate fully
in those proceedings, except that he/she shall not be afforded the
right to vote or be permitted to attend executive sessions of the
Board of the Fanny Chapman Swimming Pool.

All funds transferred to the Borough of Doylestown by the Trustees
of the Fanny Chapman Swimming Pool, all funds hereafter received by
gift, devise or bequest for the benefit of the swimming pool and all
receipts from the operation of the pool shall be held in a separate
account by the Borough Treasurer to be known as Doylestown Borough
Trustee of the Fanny Chapman Swimming Pool. The funds in said account
shall be used solely for the instruction program and the operation,
maintenance and improvement of the swimming pool, its grounds, equipment
and buildings.

Receipts from the operation of the swimming pool shall be deposited
by the Borough Treasurer in the Trustee Account of the Fanny Chapman
Swimming Pool. All disbursements from the said Account shall first
be approved by Borough Council in the same manner as other funds of
the Borough are disbursed.

The Board of Managers of the Fanny Chapman Swimming Pool shall,
on or before the 31st day of December of each year, submit a proposed
budget for the following calendar year to Borough Council for its
approval. On or before the 31st day of December of each year the Board
shall also submit a brief written report of the operation of the swimming
pool to the Secretary of the Borough and a statement of proposed changes
in methods of operation for the approval of Borough Council.

Nothing contained in a resolution adopted by Borough Council
on November 19, 1945, appointing a Committee, now known as the War
Memorial Commission, and giving such Committee authority to supervise
and maintain the athletic fields and playgrounds of the Borough of
Doylestown shall be construed to affect the Fanny Chapman Swimming
Pool. To the extent and only to the extent that said resolution would
otherwise confer any jurisdiction in said Committee over the Fanny
Chapman Swimming Pool or any of its activities it is hereby repealed.

This Part shall be known and may be cited as the "Doylestown
Ordinance Regulating Conduct in Public Parks and Recreation Areas."

For the purposes of this Part 2, the following terms, phrases,
words, and their derivations shall have the meaning given herein.
When not inconsistent with the context, words used in the present
tense include the future, words in the plural number include the singular
number, and words in the singular number include the plural number.
The word "shall" is always mandatory and not merely directory.
The Borough of Doylestown.
The Borough Manager, the person immediately in charge of
any park area and its activities, and to whom all park attendants
of such area are responsible.
A park, reservation, playground, recreation center or any
other area in the Borough, owned or used by the Borough, and devoted
to active or passive recreation.
Any person, firm, partnership, association, corporation,
company or organization of any kind.
Any wheeled conveyance, whether motor powered, animal-drawn,
or self-propelled. The term shall include any trailer in tow of any
size, kind or description. Exception is made for baby carriages and
vehicles in the service of the Borough of Doylestown.

No person in a park shall:
1.
Buildings and Other Property.
A.
Disfiguration and Removal. Wilfully mark, deface, disfigure, injure,
tamper with, or displace or remove, any building, bridges, tables,
benches, fireplaces, railings, fences, paving or paving material,
water lines or other pubic utilities or parts of appurtenances thereof,
signs, notices or placards whether temporary or permanent, monuments,
stakes, posts, or other boundary markers, or other structures or equipment,
facilities or park property or appurtenances whatsoever, either real
or personal.
B.
Restrooms and Washrooms. Fail to cooperate in maintaining restrooms
and washrooms in a neat and sanitary condition. No person over the
age of six years shall use the restrooms and washrooms designated
for the opposite sex.
C.
Removal of Natural Resources. Dig, or remove any soil, rock, stones,
trees, shrubs or plants, down-timber or other wood or materials, or
make any excavation by tool, equipment, blasting, or other means or
agency.
D.
Erection of Structures. Construct or erect any building or structure
of whatever kind, whether permanent or temporary in character, or
run or string any public service utility into, upon, or across such
lands, except on special written permit issued hereunder.
2.
Trees, Shrubbery, Lawns.
A.
Injury and Removal. Damage, cut, carve, transplant or remove any
tree or plant or injure the bark, or pick the flowers or seeds, of
any tree or plant. Nor shall any person attach any rope, wire, or
other contrivance to any tree or plant. A person shall not dig in
or otherwise disturb grass areas, or in any other way injure or impair
the natural beauty or usefulness of any area.
B.
Climbing Trees, etc. Climb any tree or walk, stand or sit upon monuments,
vases, fountains, railing, fences or guncarriages or upon any other
property not designated or customarily used for such purposes.
C.
Hitching of Animals. Tie or hitch a horse or other animal to any
tree or plant.

No person in a park shall:
1.
Pollution of Waters. Throw discharge, or otherwise place or cause
to be placed in the waters of any fountain, pond, lake, stream, or
other body of water in or adjacent to any park or any tributary, stream,
storm sewer, or drain flowing into such waters, any substance, matter
or thing, liquid or solid, which will or may result in the pollution
of said waters.
2.
Refuse and Trash. Have brought in or shall dump, deposit or leave
any bottles, broken glass, ashes, paper, boxes, cans, dirt, rubbish,
waste, garbage, or refuse, or other trash. No such refuse or trash
shall be placed in any waters in or contiguous to any park, or left
anywhere on the grounds thereof, but shall be placed in the proper
receptacles where these are provided; where receptacles are not so
provided, all such rubbish or waste shall be carried away from the
park by the person responsible for its presence, and properly disposed
of elsewhere.

No person in a park shall:
1.
State Motor Vehicle Laws Apply. Fail to comply with all applicable
provisions of the state motor vehicle traffic laws in regard to equipment
and operation of vehicles together with such regulations as are contained
in this and other ordinances.
2.
Enforcement of Traffic Regulations. Fail to obey all traffic officers
and park employees, such persons being hereby authorized and instructed
to direct traffic whenever and wherever needed in the parks and on
the highways, streets or roads immediately adjacent thereto in accordance
with the provisions of these regulations and such emergency regulations
as may be issued subsequently by the Manager.
3.
Obey Traffic Signs. Fail to observe carefully all traffic signs,
indicating speed, direction, caution, stopping, or parking, and all
others posted for proper control and to safeguard life and property.
4.
Speed of Vehicles. Ride or drive a vehicle at a rate of speed exceeding
15 miles an hour, except upon such roads as the Manager may designate,
by posted signs, for speedier travel.
5.
Operation Confined to Roads. Drive any vehicle on any area except
the paved park roads or parking areas, or such other areas as may
on occasion be specifically designated as temporary parking areas
by the Manager.
6.
Parking.
A.
Designated Areas. Park a vehicle in other than an established or
designated parking area, and such use shall be in accordance with
the posted directions and with the instructions of any attendant or
police officer who may be present.
B.
Night Parking. Leave a vehicle standing or parked at night except
in a legally established parking area.
C.
Emergency Procedure. Fail to immediately notify an attendant or police
officer of an emergency in the nature of a breakdown requiring the
assistance of a tow-truck, mechanic or other person.
D.
Double-Parking. Double-park any vehicle on any road or parkway unless
directed by a park official.
E.
Muffler Required. Fail to use a muffler adequate to deaden the sound
of the engine in a motor vehicle.
7.
Bicycles.
A.
Confined to Roads. Ride a bicycle on other than a paved vehicular
road or path designated for that purpose. A bicyclist shall be permitted
to wheel or push a bicycle by hand over any grassy area or wooded
trail or on any paved area reserved for pedestrian use.
B.
Operation. Ride a bicycle other than on the right-hand side of the
road paving as close as conditions permit, and bicycles shall be kept
in a single file when two or more are operating as a group. Bicyclists
shall at all times operate their machines with reasonable regard to
the safety of others.
C.
Designated Racks. Leave a bicycle in a place other than a bicycle
rack when such is provided and there is a space available.
D.
Immobile. Leave a bicycle lying on the ground or paving, or set against
trees, or in any place or position where other persons may trip over
or be injured by them.
E.
Night Operation. Ride a bicycle on any road between one hour after
sunset or before one hour before sunrise without an attached headlight
plainly visible at least 200 feet in front of, and without a red taillight
or red reflector plainly visible from at least 200 feet from the rear
of such bicycle.

No person in a park shall:
1.
Bathing and Swimming.
A.
Designated Areas. Swim, bathe, or wade in any waters or waterways
in or adjacent to any park, except in such waters and at such places
as are provided therefor, and in compliance with such regulations
as are herein set forth or may be hereafter adopted. Nor shall any
person frequent any waters or places customarily designed for the
purpose of swimming or bathing, or congregate thereat when such activity
is prohibited by the Manager upon a finding that such use of the water
would be dangerous or otherwise inadvisable.
B.
Certain Hours. Frequent any waters or places designated for the purpose
of swimming or bathing, or congregate thereat, except between such
hours of the day as shall be designated by the Manager for such purposes
for each individual area.
C.
Costume. Allow himself to be so covered with a bathing suit as to
indecently expose his person or call forth merited criticism. No person
shall appear in bathing costume at any place in the parks except within
the limits of designated bathing places or areas, and all bathing
costumes shall conform to commonly accepted standards.
D.
Bath-Houses. Dress or undress on any beach, or in any vehicle, toilet
or other place, except in such bathing houses or structures as may
be provided for that purpose.
2.
Fishing.
A.
General Prohibition. Fish in any waters, whether by the use of hook-and-line,
net, trap, or other device, except in waters designated by the Manager
for that use and under such regulations and restrictions as have been
or may be prescribed by the Manager.
3.
Hunting. Hunt, trap or pursue wildlife at any time. No person shall
use, carry, or possess air rifles, spring guns, bows and arrows, slings
or any other forms of weapons potentially inimical to wildlife and
dangerous to human safety, or any instrument that can be loaded with
and fire blank cartridges, or any kind of trapping device. Shooting
into park areas from beyond park boundaries is forbidden.

4.
Picnic Areas and Use.
A.
Regulated. Picnic or lunch in a place other than those designated
for that purpose. Attendants and Borough police shall have the authority
to regulate the activities in such areas when necessary to prevent
congestion and to secure the maximum use for the comfort and convenience
of all. Visitors shall comply with any directions given to achieve
this end.
B.
Availability. Violate the regulation that use of individual fireplaces
together with tables and benches follows generally the rule of "First
come, first served."
C.
Non-exclusive. Use any portion of the picnic areas or of any of the
buildings or structures therein for the purpose of holding picnics
to the exclusion of other persons, nor shall any person use such area
and facilities for an unreasonable time if the facilities are crowded.
D.
Duty of Picnicker. Leave a picnic area before any fire is completely
extinguished and before all trash in the nature of boxes, papers,
cans, bottles, garbage and other refuse is placed in the disposal
receptacles where provided. If no such trash receptacles are available,
then refuse and trash shall be carried away from the park area by
the picnicker to be properly disposed of elsewhere.
5.
Camping. No person shall camp in or set up tents, shacks, or any
other temporary shelter for the purpose of overnight camping, nor
shall any person leave in a park after closing hours any movable structure
or special vehicle to be used or that could be used for such purpose,
such as house-trailer, camp-trailer, camp-wagon, or the like.
6.
Games. Take part in or abet the playing of any games involving thrown
or otherwise propelled objects such as balls, stones, arrows, javelins
or model airplanes except in areas set apart for such forms of recreation
or at booths set up at fairs with the approval of the Manager. The
playing of rough or comparatively dangerous games such as football,
baseball and quoits is prohibited except on the fields and courts
or areas provided therefor. Roller-skating shall be confined to those
areas specifically designated for such pasttime. Provided, however,
that not to exceed four persons may play "catch" with a baseball or
football at such distance from other persons that no one else can
be struck by the ball or otherwise endangered by such activity.
7.
Horseback Riding. Ride a horse except on designated bridle trails.
Where permitted, horses shall be thoroughly broken and properly restrained,
and ridden with due care, and shall not be allowed to graze or go
unattended, nor shall they be hitched to any rock, tree or shrub.

No person in a park shall:
2.
Fireworks and Explosives. Except at public exhibitions under the
supervision or with the approval of the Manager, bring or have in
his possession, or set off or otherwise cause to explode or discharge
or burn, any firecrackers, torpedo, rocket, or other fireworks or
explosives or inflammable material, or discharge them or throw them
into any such area from land or highway adjacent thereto. This prohibition
includes any substance, compound, mixture, or article that in conjunction
with any other substance or compound would be dangerous from any of
the foregoing standpoints.
3.
Domestic Animals. Except at shows or exhibitions for which a permit
has been granted, have been responsible for the entry of a dog or
other domestic animal into areas other than automobile parking concourses
and walks immediately adjacent thereto, and in such other areas as
may be clearly marked by signs bearing the words "Domestic Animals
Permitted in This Area." Nothing herein shall be construed as permitting
the running of dogs at large. All dogs in those areas where such animals
are permitted shall be restrained at all times on adequate leashes
not greater than six feet in length.
4.
Dress. Appear at any place in other than proper clothing. With the
exception of the restricted bathing areas, "properly clothed" shall
be construed to prohibit the wearing of trunks or clothing that does
not cover the upper portion of the body; provided, that the upper
portion of the male body may be uncovered during games or exercises.
5.
Fires. Build or attempt to build a fire except in such areas and
under such regulations as may be designated by the Manager.
6.
Closed Areas. Enter an area posted as "Closed to the Public," nor
shall any person use, or abet the use of any area in violation of
posted notices.
7.
Gambling. Engage in gambling.
8.
Going Onto Ice. Go onto ice on any of the waters except such areas
as are designated as skating areas, and provided a safety signal is
displayed.
9.
Loitering and Boisterousness. Sleep or protractedly lounge on the
seats, or benches, or other areas, or engage in loud, boisterous,
threatening, abusive, insulting or indecent language, or engage in
any disorderly conduct or behavior tending to a breach of the public
peace.
10.
Exhibit Permits. Fail to produce and exhibit any permit from the
Manager he claims to have upon request of any authorized person who
shall desire to inspect the same for the purpose of enforcing compliance
with any ordinance or rule.
11.
Interference with Permittees. Disturb or interfere unreasonably with
any person or party occupying any area, or participating in any activity,
under the authority of a permit.
12.
Smoking. Possess or use any lit tobacco product, including, but not
limited to, pipes, cigars, and cigarettes.

1.
Hours. Except for unusual and unforeseen emergencies, parks shall
be open to the public every day of the year during designated hours.
The opening and closing hours for each individual park shall be posted
therein for public information.
2.
Closed Areas. Any section or part of any park may be declared closed
to the public by the Manager at any time and for any interval of time,
either temporarily or at regular and stated intervals (daily or otherwise)
and either entirely or merely to certain uses, as the Manager shall
find reasonably necessary.
3.
Permit. With the exception of regularly scheduled educational or
recreational activities under the active supervision of the Central
Bucks School District, no activity shall be scheduled or held in a
park or recreation area which will or may involve the attendance of
more than 50 persons without first obtaining a permit for such activity
from the Manager which shall first be approved by Borough Council
and issued subject to the following regulations:
A.
Application. A person seeking issuance of a permit hereunder shall
file an application with the Manager. The application shall state:
1.
The name and address of the applicant;
2.
The name and address of the person, persons, corporation or association
sponsoring the activity, if any;
3.
The day and hours for which the permit is desired;
4.
The park or portion thereof for which such permit is desired;
5.
An estimate of the anticipated attendance and the basis, if any,
for the estimate;
6.
The activity or activities which will occur or be carried on;
7.
Whether those whose attendance is anticipated reside within the Borough,
within the Central Bucks School District or outside of such School
District;
8.
The type or types of transportation which those in attendance will
use;
9.
The anticipated requirements of those expected to attend for water,
toilet facilities, food, lodging, medical or emergency care or facilities
and any other services or facilities which will be required or which
can reasonably be anticipated;
10.
What structures or facilities (such as tennis courts, football or
baseball fields, bleachers, lights, etc.) now in existence the applicant
desires to use or to make available for the use of those expected
to attend;
11.
What structures (such as fences, lights, public address systems,
chemical toilets, electrical power outlets and lights) not now available
the applicant will require and the name of the companies or persons
furnishing such services or facilities;
12.
The anticipated number of automobiles for which parking will be required,
the location of such parking and the names of those who will act as
parking attendants;
13.
The number of police or other peace officers which will be required
for traffic, parking and crowd control and the names of any officers
to be used for any of such purposes in addition to the members of
the Doylestown Police Department; and
14.
Any other information which the Manager believes to be reasonably
necessary to a fair determination as to whether a permit should issue
hereunder.
B.
Standards for Issuance. No permit shall issue except with approval
of Borough Council. A permit shall be issued when Borough Council
finds:
1.
That the proposed activity or use of the park or recreation area
will not unreasonably interfere with or detract from the general public
enjoyment of the area;
2.
That the proposed activity and use will not unreasonably interfere
with or detract from the promotion of public health, welfare, safety
and recreation;
3.
That the proposed activity or use is not reasonably anticipated to
incite violence, crime or disorderly conduct;
4.
That the proposed activity will not entail unusual or burdensome
expense to the Borough and its taxpayers;
5.
That there is adequate parking space available for the probable number
of automobiles which will be present;
6.
That there is no substantial likelihood of damage to existing structures,
facilities or equipment;
7.
That the applicant is able to and will provide such additional facilities,
service and equipment as will be required for those expected to attend;
8.
That the number of police available will be adequate to ensure public
safety, not only at the park or recreation area but throughout the
Borough (the Manager shall consult with the Chief of Police and forward
his recommendation to Borough Council);
9.
That the facilities desired have not been reserved for other use
at the day and hour required in the application;
10.
That liability insurance, endorsed to insure the Borough as well
as the applicant and any sponsoring institution, with coverage limits
not less than $500,000 for each person, $1,000,000 for each accident
and $1,000,000 property damage has been provided and the endorsements
duly exhibited to the Manager;
11.
In the case of War Memorial Field, that the Central Bucks School
Board has approved such use so long as it maintains said Field or
that Doylestown Borough Council has directed the issuance of a permit
for such Field.
C.
Appeal. Within five days after the next meeting of Borough Council
after receipt of an application, the Manager shall apprise an applicant
in writing of Council's reasons for refusing a permit or that
a permit has been granted and any conditions which have been imposed
by Council in granting it.
D.
Effect of Permit. A permittee shall be bound by all park and recreation
rules and regulations and all applicable ordinances fully as though
the same were inserted in said permits.
E.
Liability of Permittee. The person or persons to whom a permit is
issued shall be liable for any loss, damage or injury sustained by
any person whatever by reason of the negligence of the person or persons
to whom such permit shall have been issued. Likewise, the permittee
shall repair all damage and restore the property used to the same
condition it was in prior to the use by the permittee, regardless
of the cause of the damage or loss.
F.
Revocation. The Manager shall have the authority to revoke a permit
upon a finding of violation of any rule or ordinance; subject, however,
to the right of the permittee to appeal such revocation to Borough
Council within three days after it occurs.

1.
Officials. The Manager, Borough police and park attendants shall,
in connection with their duties imposed by law, diligently enforce
the provisions of this Part 2.
2.
Ejectment. The Manager, Borough police and any park attendant shall
have the authority to eject from the park any person acting in violation
of this Part 2.

Any person, firm or corporation who shall violate any provision
of this Part 2 shall, upon conviction thereof, be sentenced to pay
a fine of not more than $300; and/or to imprisonment for a term not
to exceed 90 days.
