It is the purpose of this article to expand the geographical
area of residency of the Town Building Inspector-Code Enforcement
Officer. This article is enacted pursuant to Municipal Home Rule Law
§ 10.
Notwithstanding the provision of New York State Public Officers
Law § 3 requiring a person to be a resident of the political
subdivision or municipal corporation of the state for which he or
she shall be chosen or within which his or her official functions
are required to be exercised, a person holding the office of Building
Inspector-Code Enforcement Officer need not be a resident of the Town
of Stillwater, but shall reside within Saratoga County, State of New
York.
This article shall take effect upon being filed in the office
of the New York Secretary of State, but, before then, shall be immediately
effective upon anyone personally served with a copy after its adoption
by the Stillwater Town Board.
