In accordance with § 66.0217(2), Wis. Stats., and the petition for direct annexation filed on the 22nd day of September 2008, signed by all of the owners of the real estate in the territory, the territory described on the attached Exhibit A, in the Town of Polk, Washington County, Wisconsin, is annexed to the Village of Richfield, Washington County, Wisconsin. A map of the area to be annexed is attached as Exhibit B. There are no electors residing in the territory.[2]

From and after the date of this ordinance, the territory described in § A400-1 shall be a part of the Village of Richfield, Washington County, Wisconsin, for any and all purposes provided by law, and all persons coming or residing within such territory shall be subject to all ordinances, rules and regulations governing the Village of Richfield, Washington County, Wisconsin.
Upon recommendation of the Plan Commission, the territory annexed to the Village of Richfield by this ordinance is temporarily zoned M-4 Industrial Park District.
The territory described in § A400-1 of this ordinance is hereby made a part of District 3, Ward 10, of the Village of Richfield, subject to the ordinances, rules and regulations of the Village of Richfield governing wards.
If any provision of this ordinance is invalid or unconstitutional, or if the application of this ordinance to any person or circumstances is invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the other provisions or applications of this ordinance which can be given effect without the invalid or unconstitutional provision or application.
Pursuant to § 66.0217(14), Wis. Stats., the Village Board agrees to pay annually to the Town of Polk, for five years, an amount equal to the amount of property taxes that the town levied on the annexed territory, as shown by the tax roll under § 70.65, Wis. Stats., in 2008, the year in which the annexation is final.
This ordinance shall take effect upon passage and publication as provided by law.
