It shall be unlawful for any person to operate any type of unlicensed motor-driven vehicle or conveyance, including but not necessarily limited to snowmobiles, two-wheel motor vehicles known as "mini bicycles," "trail bicycles," and "motor scooters" and four-wheel motor vehicles commonly known as "go-carts" upon any public property or Borough-owned land in the Borough of Lindenwold, New Jersey.
As used in this chapter, the following terms shall have the meanings indicated:
BOROUGH-OWNED LAND
Includes all parks, recreation areas, ball parks, lake areas, storage facilities, garage areas, Board of Education property and any and all other Borough- or publicly owned land and premises.
PUBLIC PROPERTY
Includes all streets, sidewalks, easements or any other areas dedicated or commonly used for vehicular or pedestrian traffic.
The operation of said motor-driven vehicles as defined in § 349-1 of this chapter is additionally prohibited upon private property unless the operator of said motor-driven vehicle has in his possession an express written permission to operate said vehicle on said private property by the owner of said property.
It shall be unlawful to operate any unlicensed motor-driven vehicle as defined in § 349-1 in such a manner as to create loud, unnecessary or unusual noise so as to disturb or interfere with the peace and quiet of other persons.
It shall be unlawful to operate any unlicensed motor-driven vehicle as defined in § 349-1 in a careless, reckless or negligent manner so as to endanger the safety of any person or the property of any person.
It shall not be unlawful for any employee of this Borough to operate motor-driven vehicles as defined in § 349-1 for the purpose of maintaining, repairing or doing any public work within the scope of his employment.
It shall be unlawful for the parent, guardian or any person having the care, custody and control of any child under the age of 17 years to permit such child to operate a motor-driven vehicle in violation of the terms of this chapter.
Any child, operator or parent, as defined in this chapter, who shall violate any of the provisions of this chapter shall forthwith voluntarily or involuntarily surrender the unlicensed motor-driven vehicle or conveyance to the Borough of Lindenwold Police Department, and said Police Department shall impound and store said unlicensed motor-driven vehicle or conveyance at the expense of the child, operator or parent until further order of the court having jurisdiction to determine violations existing under this chapter.
Any child, operator or parent, as defined in this chapter, who shall violate any of the provisions of this chapter shall, upon conviction thereof, be subject to the penalties as set forth in Chapter 1, § 1-1, of this Code.
