Any structure, material or thing, or groups of things, animate, or inanimate, or any part or portion thereof, belonging to any person, or owner (whether for sale or use, for any purpose whatever, whether intended to be movable or immovable, and whether as part of, or as a convenience, addition or ornament to, any building or business, and whatsoever the use or purpose may be) on, under or over any portion of any highway (including the sidewalks thereof), is hereby declared to be unlawful and to be a nuisance and removable as such, except only in the following instances and circumstances, and then only provided that in these excepted instances and circumstances, they are maintained and used, in the judgment of the Board of Township Commissioners, through its Chief of Police or Health Officer or any other designated Township representatives or officers, so as not to endanger the safety of persons or property, so as not to injure or interfere with the health, comfort and convenience of the users of the highways and the inhabitants residing therein, and so as to carry out the purposes for which they are permitted:
A. 
Exceptions allowed:
(1) 
Any construction or use under a valid Township ordinance not inconsistent with the specific provisions of this article.
(2) 
Any construction or use which cannot be subjected to municipal regulation of the character herein proposed.
(3) 
Any construction or use made or maintained by the Township itself in the discharge of its municipal functions or duties.
Unless otherwise expressly stated, the following words shall, for the purpose of this article, have the meanings herein indicated:
AUTOMOBILE OWNER
A person in whose name a vehicle is registered or licensed as required by law.
BAILEE
A person, not the owner, who has right to possession, custody, or control of any of aforementioned materials, structure, substance or thing.
MATERIAL
Any substance, animate or inanimate, similar to, but not necessarily limited to, the following: building materials, excavated materials, furniture, equipment of any nature, junk automobiles, unlicensed automobiles, automobiles, whether licensed or not, resting on blocks or other supports, rendering said vehicles in an inoperative or immovable state, automobiles, whether licensed or not, standing in state of disrepair or dismantlement (excepting the case of emergency repairs), or parts of automobiles or any other machinery or devices whatever.
OWNER
A person to whom any of the aforementioned materials, structures, substances, things or groups of things belong in title, or right to possession and control.
PERSON
Any individual, firm copartnership or corporation.
PREMISES or PROPERTY
The lot, ground or property abutting or fronting any street or highway.

Any person, firm or corporation who shall violate any provision of this article shall, upon conviction thereof, be sentenced to pay a fine of not more than $1,000 and/or to imprisonment for a term not to exceed 30 days. Every day that a violation of this article continues shall constitute a separate offense.
