GENERAL REFERENCES
Uniform construction codes — See Ch. 120.
Zoning — See Ch. 300.
As used in this chapter, the following terms shall have the meanings indicated:
ACCESSORY STRUCTURE
For the purposes of this chapter, shall mean and include any and all communication apparatuses.
AERIAL and ANTENNA
Any device, rod or wire used to receive and/or transmit radio waves.
BOCA BUILDING CODE
The BOCA codes adopted by the Township of North Versailles as defined in Chapter 5 of the North Versailles Township Code of Ordinances.[1]
BUILDING INSPECTOR
That person or entity named by the North Versailles Township Board of Commissioners from time to time.
COMMUNICATION APPARATUS
Any device, implement or thing used to send and/or receive signals including, but not limited to, an aerial, antenna, dish antenna, freestanding antenna, parabolic dish and satellite dish.
DISH ANTENNA
Includes a parabolic or satellite dish.
FREESTANDING ANTENNA
One that is not attached to any other structure.
PARABOLIC DISH and SATELLITE DISH
A directional microwave antenna, which may be concave and may have a reflector, used to receive and/or transmit communication signals.
SIGNAL
An electrical, microwave, sound or light signal.

Hereinafter, no communication apparatus may be erected, changed, altered, or used, whether attached to another structure or tower or as a freestanding communication apparatus, except in compliance with this chapter.
A. 
An accessory structure permit shall be required prior to the installation or construction of any communication apparatus.
B. 
Permits may be obtained by submitting an application to the Building Inspector on forms prepared by the officer. All applications must include the following data:
(1) 
A description of the communication apparatus, including make, model, full dimensions, capacity and schematic drawings of the means of wiring.
(2) 
A plot plan of the real estate where the communication apparatus is to be installed, showing how it is to be installed, on what structure it is to be installed, the means of installation, all property lines, power and utility lines, all improvements, all existing communications apparatuses, all existing elevations and all proposed elevations.
(3) 
For communication apparatuses proposed to be erected upon any other structure, including a freestanding tower or other edifice of any nature, engineering calculations regarding weight, location on the structure, structural integrity, and the location of all existing equipment of any nature, and communication apparatuses on the structure and the proposed communication apparatus.
(4) 
Detailed drawings, including such sufficient engineering specificity which, in the discretion of the Building Inspector, is necessary so that he is able to ascertain all circumstances and data to adequately assess the installation. The drawings shall minimally include method of connection to the structure.
C. 
The following fee schedule shall apply:
(1) 
Dish antennas having a radius of two feet or less shall pay a permit fee of $5.
(2) 
Communication devices other than dish antennas which are 12 feet in height or less and are used exclusively for private, noncommercial use shall pay a permit fee of $5.
(3) 
All other communication devices shall pay a fee in the amount of $50.
(4) 
In the event it is necessary for the Building Inspector to make an on-site inspection to assess the application, the applicant shall pay the Township the sum of $50 for each such inspection.
(5) 
The fee schedule provided for herein may be change by the Township of North Versailles hereinafter by simple resolution.
A. 
Communication apparatus shall be permitted in all zoning districts with the following restrictions:
(1) 
No communication apparatus shall be nearer to a lot line than the total height of the overall apparatus from the ground.
(2) 
No communication apparatus shall be erected in the front yard or front area of any building or structure.
(3) 
There shall be no more than one communication apparatus on any single lot.
(4) 
Freestanding dish antennas or those resting on the ground shall not exceed a diameter of 12 feet and may not exceed 15 feet in overall height.
(5) 
In respect to freestanding towers existing on April 21, 1997, the date of the moratorium passed by North Versailles Township, no additional communication devices may be installed, except in compliance with this chapter.
B. 
In all residential-zoned districts the following restrictions will apply:
(1) 
Roof-mounted communication apparatuses may only be on a portion of a roof which slopes away from the front of the lot of such building and no part of the communication apparatus shall project above the ridgeline of said building.
(2) 
No roof-mounted communication apparatus may exceed four feet in diameter or depth.
C. 
In all zoning districts except residential, no roof-mounted communication apparatus may exceed 12 feet in diameter or depth.
D. 
The restrictions in this section shall not be applicable to government buildings. If a building is a government building and the same is conveyed to a nongovernment owner, then this exception shall no longer exist and the new owner must apply for a permit pursuant to this chapter.
A. 
Every communication apparatus must be in compliance with the standards and provisions of the BOCA building codes in this chapter. Snow load provision will be waived when the communication apparatus is properly equipped with a heater to prevent the accumulation of ice.
B. 
No projection of any communication apparatus or supporting structure may be in such proximity to any electric or telephonic line so as to constitute a danger in the discretion of the Building Inspector.
C. 
All connections to any supporting structure shall be properly flashed so as to be watertight. In the event of removal of a communications apparatus, repairs must be made to any roof so that it remains watertight.
