Upon written application by an applicant, the Township Board
of Supervisors may, in its discretion, approve or deny a request for
a waiver of the provisions of this Chapter if the applicant demonstrates
to the satisfaction of the Township Board of Supervisors that literal
compliance will be unreasonable, will cause undue hardship because
of peculiar conditions relating to the land, when an alternative standard
is shown to provide equal or better results, and when such alternative
will not be contrary to the public interest and observes the purpose
and intent of this Chapter.

Upon written request by an applicant, the Township, through
consultation with the Township Engineer, may authorize the use of
alternative standards, practices or materials, provided that the applicant
establishes that such alternative standards, practices or materials
produce results that are equal to or better than the standards, practices
or materials required by this Chapter, and further provided that such
alternatives will not be contrary to the public interest and observes
the purpose and intent of this Chapter.

(a) Any person, persons, association or corporation who shall violate
or fail to comply with any of the provisions of this Chapter shall,
upon summary conviction, pay a fine not exceeding $1,000 and costs
of prosecution for each and every offense or shall undergo imprisonment
in the Berks County Prison to the extent allowed by law for the punishment
of summary offenses.
(b) Each day that the violation continues shall constitute a separate
violation, if a separate proceeding is instituted therefor and the
violator shall be convicted thereof.
(c) The Township shall also be permitted to enforce the provisions of
this Chapter through an action in equity brought in the Berks County
Court of Common Pleas.
