A. 
The following performance standards and limitations shall apply to all buildings and premises in the City:
(1) 
Any use established in any district shall meet all the requirements of the New Jersey Air Pollution Control Code, as amended and augmented by regulations now in effect or hereafter adopted; the New Jersey Noise Control Act of 1971, N.J.S.A. 13:1G-1 et seq., as amended and augmented by regulations now in effect or hereafter adopted; the New Jersey Water Pollution Control Act of 1977, N.J.S.A. 58:10A-1 et seq., as amended and augmented by regulations now in effect or hereafter adopted; and all other applicable state and federal environmental control legislation.
(2) 
All drainage discharge and other disposal of liquids and solid matter shall be so designed as to comply with all existing City ordinances, to avoid accumulation of such matter on the premises, and to eliminate the diversion of the same into adjoining properties or public areas.
(3) 
No use shall be permitted which causes radioactivity in violation of Title 10, Chapter 1, Part 20, Code of Federal Regulations, Standards for Protection Against Radiation, dated June 16, 1957, or any subsequent revision or amendment thereto.
(4) 
No noise shall be permitted which is greater than that permitted by the provisions of this chapter or other ordinances of the City.
(5) 
No use shall be permitted which does not conform to the provisions of Chapter 94, Air Pollution, of the Code.
(6) 
No use which creates a hazard due to risk of fire or explosion shall be permitted.
(7) 
No violation which is detectable without instruments at the property line shall be permitted.
(8) 
No direct or sky-reflected glare, whether from light or from high-temperature processes, such as combustion or welding, visible at the property line shall be permitted.
(9) 
No use which impairs radio or television reception in the vicinity shall be permitted. No amateur radio operations shall be permitted in any residential property.
(10) 
No use which creates any noxious odor or fumes, detectable at any point outside the structure in which the use is enclosed, shall be permitted.
(11) 
No exterior storage exposed to view from adjoining premises, public rights-of-way or parking areas utilized in conjunction with buildings on the premises shall be permitted.
(12) 
No use which creates any other nuisance or hazard which is detrimental to public health, safety or welfare shall be permitted.
B. 
Enforcement of performance standards. Satisfactory evidence shall be presented to the Administrative Officer that the proposed use shall conform to the performance standards above. The Administrative Officer may obtain expert advice, at the expense of the applicant, regarding performance standards.
C. 
In the event of failure to comply with the provisions of this chapter, including any conditions of site plan approval and any performance standards as stated herein, the Construction Official shall take steps as may be lawful to enforce such provisions.
